Si les autorités françaises ont bien rendu visite à la Commission le 24 novembre 2004 et lui ont écrit officiellement le 21 décembre 2004 pour l’informer du choix de vendre les actifs en bloc, sans en décrire les éléments essentiels, il convient de souligner qu’à aucun moment la France n’a notifié à la Commission une modification du plan de restructuration approuvé de manière conditionnelle par cette dernière dans la décision Sernam 2.
Although the French authorities did visit the Commission on 24 November 2004 and wrote to it officially on 21 December 2004 to inform it of the choice to sell the assets en bloc, without describing the key components, it should be stressed that at no time did France notify the Commission of any changes to the restructuring plan conditionally approved by the latter in the Sernam 2 Decision.

S’il est vrai que, pour ce qui concerne les demandes de communication des épreuves écrites b) et c), en tant qu’elle visaient les écrits réalisés par la requérante dans le cadre de ces deux épreuves, et des fiches d’évaluation desdits écrits établies par le jury, l’EPSO n’y a pas donné suite dans les délais fixés par le titre D, point 4, de l’avis de concours et ne les a pas non plus joints au courriel du 14 septembre 2009, il demeure que copie des écrits susmentionnés réalisés par la requérante ainsi que les feuilles d’évaluation de chaque épreuve établies par le jury lui ont été transmises en cours d’instance, concrètement par une lettre de l’EPSO du 16 juin 2010, et que ces documents figurent au dossier de la procédure, en tant qu’annexes au mémoire en défense de la Commission.
As regards the requests to send written tests (b) and (c), in so far as they related to the applicant’s test papers and the evaluation sheets for those papers drawn up by the selection board, EPSO did not act on them within the time-limits laid down in Section D.4 of the notice of competition, nor did it attach those documents to the e-mail of 14 September 2009; however a copy of the applicant’s papers and the evaluation sheets drawn up by the selection board for each of the tests were sent to her during the course of the proceedings, specifically by a letter from EPSO of 16 June 2010, and those documents appear in the case-file as annexes to the Commission’s defence.

Enfin, selon la requérante, elle n’aurait pas pu détailler davantage, dans sa note, son désaccord avec la décision du jury notifiée le 23 juillet 2009, car elle n’avait pas réussi à se voir communiquer ses épreuves écrites corrigées et que ce n’est que le 16 juin 2010 que l’EPSO lui avait envoyé ses épreuves écrites b) et c), mais sans les corrections.
Lastly, according to the applicant, she was not able to provide more detailed reasons in her note for her disagreement with the board’s decision notified on 23 July 2009 since she had not managed to obtain a copy of her marked written tests and it was not until 16 June 2010 that EPSO had sent her the written tests (b) and (c) she had done, but there was no indication of how the selection board had marked them.
