L’arrêt de la Cour fait suite à la demande de contrôle juridictionnel présentée par l’International Air Transport Association (IATA), la European Low Fares Airline Association (ELFAA) et Hapag-Lloyd Express auprès de la High Court of Justice of England and Wales, qui ont fait valoir l’invalidité à plusieurs titres du règlement communautaire relatif aux droits des passagers .
The Court ruling follows an application for judicial review that was first submitted by IATA (International Air Transport Association), ELFAA (European Low Fares Airline Association) and Hapag-Lloyd Express, to the High Court of Justice of England and Wales, claiming that the EU Regulation on air passenger rights was invalid on several grounds.

The International Air Transport Association (IATA), a body comprising 270 airlines from 130 countries, which carry 98% of scheduled international air passengers worldwide, and the European Low Fares Airline Association (ELFAA), which represents the interests of 10 low-fare airlines from nine European countries, contested the United Kingdom’s implementation of the regulation before the High Court of Justice of England and Wales.
