Le CESE estime que tant la nature que l’objectif de ces exemptions constituent une violation de l’article 13.7 de l’accord de libre-échange entre l’Union européenne et la Corée, qui prévoit que «[l]es parties ne peuvent affaiblir ou réduire le niveau de protection assuré par leur législation en matière d’environnement ou de travail en vue d’encourager les échanges ou les investissements, en s’abstenant d’appliquer leurs lois, règlements ou normes ou en y dérogeant d’une façon quelconque, ou en proposant de s’abstenir de les appliquer ou d’y déroger, d’une manière qui affecte le commerce ou les investissements entre les parties».
EESC considers that these exemptions, in their nature and their intent, are in breach of the EU-Korea FTA’s Article 13.7 that states ‘[a] Party shall not weaken or reduce the environmental or labour protections afforded in its laws to encourage trade or investment, by waiving or otherwise derogating from, or offering to waive or otherwise derogate from, its laws, regulations or standards, in a manner affecting trade or investment between the Parties’.
