Acknowledges the successful results achieved by the financial incentives provided for by the Bulgarian law on mediation; recognises, however, that these are also due to the long-standing interest in mediation shown by the Bulgarian legal system in that the mediation community has been in existence since 1990 and the Settlement Centre – staffed by mediators working in shifts – has since 2010 been providing free mediation services and information for parties in pending court cases on a daily basis; notes that in Bulgaria two thirds of the cases referred were mediated and half of those cases were brought to a successful conclusion in mediation;

Welcomes the fact that the process of establishing the legal and constitutional framework of the country has almost been finalised; draws attention, however, to the fact that the deadline for harmonising the existing legal system with the new constitution has been extended for the fourth time and calls on the authorities to adopt swiftly the outstanding legislation, in particular the amendments to the legal framework on elections; calls on all political parties to reach a consensus on the draft law without further delay in line with the recommendations of the OSCE-ODIHR and the Venice Commission, and to improve the mechanism for verifying election-related complaints before the Electoral Commission or the courts; calls on the Montenegrin Parliament to urgently and significantly strengthen its capacities regarding the task of assessing whether laws proposed by the government are in line with the acquis and urges the Commission to provide the necessary technical assistance in this regard within the framework of the Instrument for Pre-Accession; urges the government to make the process of law-making more transparent and publicly accessible;

Toutefois, après avoir écouté M. Zwiefka, qui nous a parlé d’une proposition d’amendement de la loi par le gouvernement polonais actuel, je demande au commissaire s’il estime que la Commission pourrait s’adresser au gouvernement polonais sur la base du débat que nous avons actuellement au Parlement pour voir s’il propose bien de modifier la loi en vue d’harmoniser le statut des députés européens avec celui des députés nationaux.
However, after listening to Mr Zwiefka, who has been telling us about a proposal from the current Polish Government to amend the law, I would ask the Commissioner whether he believes that the Commission could in fact approach the Polish Government on the basis of the debate we are having in Parliament at present to see whether the Polish Government is indeed proposing to amend the law to harmonise the status of MEPs with that of members of the national parliament.

À mon avis, les sénateurs ne devraient pas s'opposer systématiquement à un projet de loi proposé par un gouvernement d'une allégeance différente, mais je pense toutefois que le projet de loi devrait être examiné et expliqué à la population.
