Entre-temps, la Commission en est néanmoins arrivée à la conclusion que certaines dispositions de la loi grecque semblent également être contraires à la libre prestation des services, à la liberté d’établissement et être en violation de la directive 98/34/CE qui oblige les États membres à notifier les projets de règlements et de règles techniques relatifs aux services de la société de l’information.
In the meanwhile the Commission has however come to the conclusion that certain provisions of the Greek law appear to be also contrary to the freedom to provide services, the freedom of establishment as well as to Directive 98/34/EC which obliges Member States to notify draft technical regulations and rules on Information Society Services.

À la suite de la promulgation de la loi et après avoir reçu plusieurs réclamations, la Commission a envoyé une lettre de mise en demeure aux autorités grecques le 18 octobre 2002 dans laquelle il est mis en avant que la loi nº 3037/2002 introduit des mesures en violation de l’article 28 du traité CE pouvant avoir un effet équivalent à des restrictions quantitatives à l’importation de jeux et de marchandises y afférents provenant d’autres États membres et que ces mesures semblent être injustifiées et disproportionnées.
Following the enactment of the law and having received several complaints, the Commission sent, on October 18 2002, a letter of formal notice to the Greek authorities whereby it was noted that the law 3037/2002 introduces measures that may, contrary to article 28 of the EC Treaty, have an effect equivalent to quantitative restrictions to imports of games and related goods from other Member States and that those measures seem to be unjustified and disproportionate.
