Regarding the particular lawyer of that law firm, to which complainant 3 has referred in its complaint, Germany has also explained the following: (a) that lawyer worked for the Land from May 2012 until April 2013, i.e. before the initiation of the tender process in June 2013; (b) that lawyer was not in any contact with the Land or the Federal Republic of Germany during the tender process; (c) that lawyer never advised the Land or the sellers in relation to the bidding process; and (d) the same lawyer only participated as an independent expert in the hearing of the Land's parliament on 20 June 2013 concerning the law for the public access to the Nürburgring racetrack.

E. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, Members of the National Council (Nationalrat) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

I am delighted that this report has borrowed heavily from the Austrian Federal Act on the Protection of Animals, which is really very practicable and is concerned with keeping animals in conditions appropriate to the respective species.

(89) Disposition 5.1 du contrat BSCA-Ryanair: "Aucune partie ne fera d'annonce publique ou d'autre communication concernant les matières traitées dans le cadre du présent contrat ou de ses annexes avant que les autres parties aient reçu un projet de la divulgation envisagée ou de la communication à faire et avant que ces parties aient donné leur consentement préalable par écrit, à moins que cette publication ou production de documents soit exigée par la loi ou par une juridiction internationale, communautaire ou fédérale, auquel cas les autres parties seront préalablement informées de la démarche de la juridiction".
(89) Provision 5.1 of the BSCA-Ryanair contract: "No party shall make a public announcement or any other communication concerning the matters dealt with under the present contract or its annexes until the other parties have received a draft of the proposed disclosure or of the communication to be made and until the parties have issued their prior written consent, unless the publication or production of documents is required by law or by an international, Community or federal court, in which case the other parties shall be informed beforehand of the steps taken by the court".

Le nouveau paragraphe 6.1(2) accorde quant à lui au ministre des Transports le pouvoir de désigner, comme il aurait pu le faire antérieurement aux termes de l’article 157.1 de la LTC, soit un organisme établi par une loi fédérale soit une personne ou catégorie de personnes œuvrant au sein de l’administration publique fédérale pour appliquer la loi conformément à cet accord.
New section 6.1(2) provides the Minister of Transport with the authority, previously found in section 157.1 of the Canada Transportation Act, to designate any body established under a federal statute, or any person or class of persons employed in the federal public administration, to administer the law in accordance with the agreement.
