Irwin Cotler: With regard to bijuralism and harmonization: (a) what measures are in place to ensure legislative bijuralism across all departments; (b) since the adoption of the “Policy on Legislative Bijuralism”, how has the Department of Justice (i) ensured that all legal counsel in the Department are made aware of the requirements of legislative bijuralism in order for them to be able to take it into account when advising client departments on legislative reforms, (ii) enhanced the capacity of the Legislative Services Branch to draft bijural legislative texts, (iii) undertook, in drafting both versions of every bill and proposed regulation that touches on provincial or territorial private law, to take care to reflect the terminology, concepts, notions and institutions of both of Canada’s private law systems; (c) since the adoption of the “Policy for Applying the Civil Code of Quebec to Federal Government Activities”, what measures are in place to ensure (i) changes to Quebec’s Civil Code are known and monitored by the government, (ii) assessment of federal legislation relative to changes to Quebec’s Civil Code, (iii) federal legislation is introduced to reflect, where necessary, changes to the Civil Code of Quebec; (d) with respect to the “Index of Bijuralism and Harmonization Caselaw” found online and indicating its most recent update was June 12, 2012, (i) how often is this page updated, (ii) given that some cases thereupon are from 2013, when was this page last updated, (iii) whose responsibility is it to update this page, (iv) what cases are currently being monitored for potential addition to this page; (e) with respect to cases involving bijuralism and harmonization, (i) in what ways are these made known to the Department, (ii) whose responsibility it is to monitor these cases, (iii), what role does the Federal government play in these cases if a party, (iv) what role does the government play if not a party, (v) who m ...

D. whereas, under Article 57(2) of the Austrian Federal Constitutional Law, members of the National Council (Nationalrat) may only be arrested on the grounds of a criminal offence with the consent of the National Council – except where they are caught in the act of committing a crime – and whereas searches of the houses of members of the National Council likewise require the consent of the National Council; whereas, further to Article 57(3) of the Austrian Federal Constitutional Law, no official action on account of a punishable offence may be taken against members of the National Council without the National Council’s consent unless that offence is manifestly not connected with the political activity of the member in question and whereas, under that provision, the authority concerned must seek a decision from the National Council as to whether such a connection exists, where this is so requested by the member in question or one third of the members of the appropriate standing committee;

The requirements of the first and second sentences of § 4 subparagraph (3) may be disregarded when an Ordinance is issued for the first time after this Federal Act comes into force, if, as part of the preparation of the notification procedure pursuant to Article 3(a)(1) and (2) of Directive 89/552/EEC as amended by Directive 97/36/EC, the parties concerned have already been consulted and the content of the Ordinance to be issued has been made known in an appropriate manner as part of this consultation.

Ces recommandations sont les suivantes : la recommandation 1, selon laquelle le gouvernement du Canada devrait prendre des mesures législatives immédiates pour ajouter une disposition de non-dérogation dans la Loi d'interprétation fédérale; la recommandation 2, selon laquelle la loi visant à modifier la Loi d'interprétation doit aussi prévoir l'abrogation de toutes les dispositions de non-dérogation concernant les droits ancestraux et issus de traités existants des peuples autochtones énoncés dans la législation fédérale depuis 1982; une directive sans équivoque selon laquelle toute disposition de non-dérogation dans la Loi d'interprétation doit être considérée comme liant la Couronne dans toutes les lois fédérales; une disposition claire selon laquelle toute disposition de non-dérogation dans la Loi d'interprétation servira de façon constructive à établir, mettre en place, surveiller et appliquer certains processus et mécanismes — on ne pourra pas présumer que les mesures ou les décisions prises par le gouvernement fédéral conviennent. Enfin, on a recommandé l'élaboration d'un code de conduite exécutoire et assujetti à un examen par les tribunaux ainsi que d'une politique et des procédures applicables dans l'ensemble du gouvernement du Canada pour concrétiser l'application de la disposition de non-dérogation dans la Loi d'interprétation fédérale.
Those recommendations include: recommendation 1 that the Government of Canada take immediate steps to introduce legislation to include a non-derogation clause within the federal Interpretation Act; recommendation 2, that the legislation to amend the Interpretation Act also provide for the repeal of all non-derogation clauses relating to Aboriginal and treaty rights included in federal legislation since 1982; unequivocal direction that any non-derogation provision in the Interpretation Act is to be ``read in'' as a provision binding the Crown in all its federal statutes; a clear provision that any non-derogation provision in the Interpretation Act will be constructive in terms of processes and mechanisms that will be established, implemented, monitored and enforced, as distinct from merely presumptive in respect of the correctness of any action or decision of the federal government; and the development of the judicially reviewable and enforceable code of conduct and the policy and procedure applicable to all of the Government of Canada to give practical effect to the inclusion of a non-derogation provision in the federal Interpretation Act.
