IN-CONTEXT TRANSLATIONS

– vu la Loi fondamentale hongroise, adoptée le 18 avril 2011 par l'Assemblée nationale de la République de Hongrie et entrée en vigueur le 1 janvier 2012 (ci-après dénommée la "Loi fondamentale"), et les dispositions transitoires de cette Loi fondamentale, adoptées le 30 décembre 2011 par l'Assemblée nationale et également entrées en vigueur le 1 janvier 2012 (ci-après les "dispositions transitoires"),
– having regard to the Fundamental Law of Hungary, adopted on 18 April 2011 by the National Assembly of the Hungarian Republic, which entered into force on 1 January 2012 (hereinafter referred to as ‘the Fundamental Law’), and the Transitional Provisions of the Fundamental Law of Hungary, adopted on 30 December 2011 by the National Assembly, which also entered into force on 1 January 2012 (hereinafter referred to as ‘the Transitional Provisions’),

11. se félicite que la Loi fondamentale hongroise rappelle et réaffirme les articles de la Charte des droits fondamentaux de l'Union européenne, et que la Hongrie soit le quatrième pays de l'Union à reconnaître, à l'article H, la langue des signes hongroise (LS hongroise) en tant que langue à part entière et défende la LS hongroise en tant qu'élément de la culture hongroise;
11. Welcomes the fact that the Fundamental Law of Hungary reiterates and reaffirms the articles of the Charter of the Fundamental Rights of the European Union, and that Hungary, as the fourth country in the EU, in Article H recognises Hungarian sign language (HSL) as a fully fledged language and defends HSL as part of Hungarian culture;

3. regrette que le processus de rédaction et d'adoption de la Loi fondamentale hongroise n'ait pas bénéficié de la transparence, de l'ouverture, de l'exhaustivité et, en définitive, de la base consensuelle que l'on peut attendre d'un processus constitutif démocratique moderne, affaiblissant ainsi la légitimité de la Loi fondamentale elle-même;
3. Regrets the fact that the process of drafting and adopting the Fundamental Law of Hungary lacked the transparency, openness, inclusiveness and, ultimately, the consensual basis that could be expected in a modern democratic constituent process, thus weakening the legitimacy of the Fundamental Law itself,

– vu la demande d'avis de la commission de Venise sur le quatrième amendement à la Loi fondamentale hongroise, envoyée le 13 mars 2013 par M. Martonyi à M. Jagland,
– having regard to the request for an opinion of the Venice Commission on the Fourth Amendment to the Fundamental Law of Hungary, sent on 13 March 2013 by Mr Martonyi to Mr Jagland,

M. Barroso fait également référence dans sa lettre à l'évaluation des récentes modifications de la Loi fondamentale hongroise menée actuellement par la Commission de Venise, qui doit rendre un avis pour le 15/16 juin.
President Barroso also in his letter refers to the on-going assessment of the recent amendments to the Hungarian Constitution conducted by the Venice Commission, which will prepare an opinion on 15-16 June.

La lettre fait notamment référence aux préoccupations de la Commission quant à la conformité avec le droit de l'Union des nouveaux articles de la Loi fondamentale hongroise relatifs aux arrêts de la Cour européenne de justice comportant des obligations de paiement, aux pouvoirs conférés au président de l'Office national de la justice lui permettant de transférer des affaires et, ce point devant faire l'objet d'une analyse plus détaillée, aux restrictions applicables à la publication des annonces politiques.
The letter in particular refers to Commission concerns about the conformity with EU law of the new articles of the Hungarian Constitution on the clause on European Court of Justice judgements entailing payment obligations, the powers given to the President of the National Office for the judiciary to transfer cases and, subject to a more detailed analysis, the restrictions on the publication of political advertisements.

Dans une lettre adressée ce jour au Premier ministre hongrois, M. Viktor Orbán, le Président de la Commission européenne, M. Barroso, confirme qu'il a bien pris note des efforts fait par le Premier ministre pour rassurer quant à la volonté et à l'engagement de la Hongrie et du gouvernement hongrois de respecter pleinement les valeurs et le droit de l'Union européenne, mais que la Commission, au terme d'une première analyse juridique, maintient ses préoccupations quant à la compatibilité du quatrième amendement de la Loi fondamentale hongroise avec la législation de l'UE et avec le principe de l'État de droit.
In a letter sent to Prime Minister Viktor Orbán today, President Barroso, while noting Prime Minister Orbán's reassurances on Hungary's and the Hungarian government's willingness and commitment to fully respect European Union values and law, confirms that, based on a first legal analysis, the Commission has serious concerns over the compatibility of the Fourth Amendment to the Hungarian Fundamental Law with EU legislation and with the principle of the rule of law.

Après avoir examiné la réponse des autorités hongroises, la Commission maintient son appréciation juridique selon laquelle la loi modifiée n'est pas compatible avec les libertés fondamentales du marché intérieur, notamment la libre prestation de services (article 56 du TFUE et article 16 de la directive 2006/123/CE relative aux services dans le marché intérieur) et la liberté d'établissement (article 49 du TFUE et articles 9, 10, 13 et 14 de la directive 2006/123/CE), ni avec la liberté académique, le droit à l'éducation et la liberté d'entreprise prévus par la charte des droits fondamentaux de l'Union européenne (respectivement articles 13, 14 et 16), ni avec les obligations juridiques de l'Union au titre du droit commercial international (à savoir l'accord général sur le commerce des services dans le cadre de l'Organisation mondiale du commerce).
Having assessed the reply by the Hungarian authorities, the Commission maintains its legal assessment that the law as amended is not compatible with the fundamental internal market freedoms, notably the freedom to provide services (Article 56 TFEU and Article 16 of Directive 2006/123/EC on services in the internal market) and the freedom of establishment (Article 49 TFEU and Articles 9, 10, 13, 14 of Directive 2006/123/EC), but also not compatible with the right of academic freedom, the right to education and the freedom to conduct a business as provided by the Charter of Fundamental Rights of the European Union (Articles 13, 14, 16 respectively), as well as not compatible with the Union's legal obligations under international trade law (the General Agreement on Trade in Services – GATS – in the framework of the World Trade Organisation, WTO).
