La détermination de la loi objectivement applicable (article 6 2) procède cependant d'un esprit différent de celui l'article 5 : tandis que pour ce dernier, la loi applicable est celle de la résidence habituelle du consommateur - loi que le consommateur connaît en général et sur la protection de laquelle il compte -, l'article 6 2 essaye de déterminer la loi avec laquelle le contrat présente les liens les plus étroits.
But the spirit behind the determination of the objectively applicable law in Article 6(2) is different from Article 5: while for Article 5, the applicable law is that of the consumer's residence, which is the law that the consumer generally knows and on the protection of which he relies, Article 6(2) tries to determine the law with which the contract is most closely connected.

Thus the future Rome I instrument could take as a starting point the preliminary draft proposal for a Council Regulation on the law applicable to non-contractual obligations (Rome II), the exception clause in Article 3(3) of which introduces two new conditions in relation to the Rome Convention: it is required that there be "a substantially closer connection [between the tortious/delictual act and] another country" and also that "there is no significant connection between the non-contractual obligation and the country whose law would be the applicable law under paragraphs 1 and 2".

2. providing for rules of private international law to ensure effective coordination between legal systems with regard to the administration, liquidation and transmission of estates, as well as identification of heirs, with provisions stating: that these aspects of succession, subject to exceptions due to the nature or location of certain assets, are to be regulated by the law applicable to the succession; that if that law provides for the intervention of an authority indicated by the law itself, or appointed pursuant to it, that authority's powers shall be recognised in all the Member States; that, if the law applicable to the succession is the law of a Member State, the powers of such authorities are to extend, unless otherwise specified by the testator, to the whole estate, wherever it may be situated, even if, according to the law applicable to the succession, those powers are confined to movable property; that the measures relating to the activity of those authorities prescribed by the law applicable to the succession may be requested from the courts of the Member State the law of which is applicable to the succession or on the territory of which the deceased person had his habitual residence at the time of his death, or on the territory of which the property comprised in the estate is located;
