D'après la législation roumaine, les actes décrits ci-dessus relèvent de l'article 6 de la loi n° 78/2000 relative à la prévention, à la détection et à la sanction des délits de corruption, en liaison avec l'article 254 (corruption) et l'article 257 (trafic d'influence) du Code pénal, ainsi qu'avec l'article 81, point b, de la loi n° 78/2000 précitée.
Under Romanian law, provision is made for the above-mentioned acts in Article 6 of Law No 78/2000 on preventing, detecting and punishing offences of corruption, in conjunction with Article 254 (corruption) and Article 257 (influence peddling) of the Criminal Code, and with Article 81(b) of Law No 78/2000 on preventing, detecting and punishing offences of corruption.

B. considérant que la levée de l'immunité d'Adrian Severin porte sur des infractions présumées de corruption au sens de l'article 6 de la loi roumaine n° 78/2000, en liaison avec l'article 254 (corruption) et l'article 257 (trafic d'influence) du Code pénal, ainsi qu'avec l'article 8 , point b, de la loi n° 78/2000,
B. whereas the waiver of the immunity of Adrian Severin concerns alleged corruption offences covered by Article 6 of Romanian Law No 78/2000 in conjunction with Article 254 (corruption) and Article 257 (influence peddling) of the Criminal Code and with Article 8 (b) of Law No 78/2000,

Le choix de la loi pourrait être considéré comme résultant d'une disposition à cause de mort dans le cas où, par exemple, dans sa disposition, le défunt avait fait référence à des dispositions spécifiques de la loi de l'État de sa nationalité ou dans le cas où il avait mentionné cette loi d'une autre manière.
A choice of law could be regarded as demonstrated by a disposition of property upon death where, for instance, the deceased had referred in his disposition to specific provisions of the law of the State of his nationality or where he had otherwise mentioned that law.

Dans le cas où il est fait référence, dans le présent règlement, à la loi qui aurait été applicable à la succession de la personne qui dispose, si elle était décédée le jour, selon le cas, de l'établissement de la disposition à cause de mort, de la modification ou de la révocation de la disposition, cette référence doit s'entendre comme étant une référence soit à la loi de l'État de la résidence habituelle de la personne concernée ce jour-là, soit, si la personne avait fait un choix de loi en vertu du présent règlement, à la loi de l'État de sa nationalité ce jour-là.
Where reference is made in this Regulation to the law which would have been applicable to the succession of the person making a disposition of property upon death if he had died on the day on which the disposition was, as the case may be, made, modified or revoked, such reference should be understood as a reference to either the law of the State of the habitual residence of the person concerned on that day or, if he had made a choice of law under this Regulation, the law of the State of his nationality on that day.

2. Lorsque le défunt avait, avant le 17 août 2015, choisi la loi applicable à sa succession, ce choix est valable s'il remplit les conditions fixées au chapitre III ou s'il est valable en application des règles de droit international privé qui étaient en vigueur, au moment où le choix a été fait, dans l'État dans lequel le défunt avait sa résidence habituelle ou dans tout État dont il possédait la nationalité.
2. Where the deceased had chosen the law applicable to his succession prior to 17 August 2015, that choice shall be valid if it meets the conditions laid down in Chapter III or if it is valid in application of the rules of private international law which were in force, at the time the choice was made, in the State in which the deceased had his habitual residence or in any of the States whose nationality he possessed.

Je me demande comment on peut me reprocher des propos qui viennent d’être repris par le chef de l’État, chef du pouvoir judiciaire, et justifier mes poursuites sur le fondement d’une loi communiste, la loi Gayssot, qui avait été qualifiée par M. Toubon de loi stalinienne lors de son adoption.
I question how it is that I can be criticised for remarks that have just been repeated by the Head of State, the head of the judiciary, and how it is that I can have the legal proceedings against me justified on the basis of a communist law, the Gayssot law, which Mr Toubon described as a Stalinist law when it was adopted.

Un contrat conclu entre des personnes ou leurs représentants, qui se trouvent dans des pays différents au moment de sa conclusion, est valable quant à la forme s'il satisfait aux conditions de forme de la loi qui le régit au fond en vertu du présent règlement ou de la loi d'un des pays dans lequel se trouve l'une ou l'autre des parties ou son représentant au moment de sa conclusion ou de la loi du pays dans lequel l'une ou l'autre des parties avait sa résidence habituelle à ce moment-là.
2. A contract concluded between persons who, or whose agents, are in different countries at the time of its conclusion is formally valid if it satisfies the formal requirements of the law which governs it in substance under this Regulation, or of the law of either of the countries where either of the parties or their agent is present at the time of conclusion, or of the law of the country where either of the parties had his habitual residence at that time.

Un acte juridique unilatéral relatif à un contrat conclu ou à conclure est valable quant à la forme s'il satisfait aux conditions de forme de la loi qui régit ou régirait au fond le contrat en vertu du présent règlement ou de la loi du pays dans lequel cet acte est intervenu ou de la loi du pays dans lequel la personne qui l'a accompli avait sa résidence habituelle à ce moment.
3. A unilateral act intended to have legal effect relating to an existing or contemplated contract is formally valid if it satisfies the formal requirements of the law which governs or would govern the contract in substance under this Regulation, or of the law of the country where the act was done, or of the law of the country where the person by whom it was done had his habitual residence at that time.
