2008/431/EC: Council Decision of 5 June 2008 authorising certain Member States to ratify, or accede to, in the interest of the European Community, the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children and authorising certain Member States to make a declaration on the application of the relevant internal rules of Community law - Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children

1. Le Conseil autorise la Belgique, l’Allemagne, l’Irlande, la Grèce, l’Espagne, la France, l’Italie, Chypre, le Luxembourg, Malte, les Pays-Bas, l’Autriche, la Pologne, le Portugal, la Roumanie, la Finlande, la Suède et le Royaume-Uni à ratifier la convention concernant la compétence, la loi applicable, la reconnaissance, l’exécution et la coopération en matière de responsabilité parentale et de mesures de protection des enfants, conclue le 19 octobre 1996 (ci-après dénommée «la convention»), ou à y adhérer, dans l’intérêt de la Communauté, sous réserve des conditions fixées aux articles 3 et 4.
1. The Council hereby authorises Belgium, Germany, Ireland, Greece, Spain, France, Italy, Cyprus, Luxembourg, Malta, the Netherlands, Austria, Poland, Portugal, Romania, Finland, Sweden and the United Kingdom to ratify, or accede to, the 1996 Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in respect of Parental Responsibility and Measures for the Protection of Children (hereinafter referred to as the Convention), in the interest of the Community, subject to the conditions set out in Articles 3 and 4.

Cette procédure ne s'applique pas aux sociétés définies à l'article 2 de la loi relative à l'impôt sur le revenu (à savoir les sociétés de commerce internationales et les sociétés holding internationales) et aux sociétés propriétaires d'un navire immatriculé conformément à la loi sur la marine marchande, si la participation de résidents n'excède pas 20 %.PLles étrangers qui sont titulaires d'un permis de résidence ou d'une autorisation de séjour toléré sur le territoire polonais ou qui bénéficient du statut de réfugié ou de la protection temporaire en Pologne peuvent entreprendre et exercer une activité économique aux mêmes conditions que les citoyens polonais; conformément aux exigences de réciprocité, les ressortissants étrangers peuvent entreprendre et exercer une activité économique sur le territoire polonais aux mêmes conditions que les entrepreneurs qui y ont leur siège, à moins que les accords internationaux ratifiés n'en disposent autrement.En l'absence de réciprocité, les ressortissants étrangers ne peuvent entreprendre et exercer une activité économique sur le territoire polonais qu'en constituant une société en commandite, une société à responsabilité limitée ou une société anonyme; ils peuvent également s'y associer ou y acquérir des participations.ROl'administrateur unique ou le président du conseil d'administration, ainsi que la moitié du nombre total d'administrateurs des sociétés commerciales, doivent être des citoyens roumains, sauf disposition contraire du contrat de la société ou de ses statuts.
This procedure does not apply to companies as defined in Article 2 of the Income Tax Act, (that is, international holding/trading companies) and to companies which own a vessel registered under the Merchant Shipping Act, and where the resident participation does not exceed 20 %.PLforeigners, who have received permission for residence on the territory of Poland, permission for tolerated stay, refugee status granted in Poland or who enjoy temporary protection on its territory, may undertake and pursue economic activity on the territory of Poland on the same rules as Polish citizens.Following reciprocity requirements, if ratified international agreements do not provide otherwise, foreign persons may take up and pursue economic activity on the territory of Poland on the same rules as entrepreneurs having their seat in Poland.When there is no reciprocity, foreign persons have the right to undertake and pursue economic activity on the territory of Poland only in a form of limited partnership, limited liability company and joint-stock company; they have also right to join these companies or to take and buy their shares or stocks.ROthe sole administrator or the Chairman of the Board of Administration as well as half of the total number of administrators of a commercial company shall be Romanian citizens unless otherwise stipulated in the company contract or in its statutes.

D’autres États membres estiment que ce principe est effectivement en vigueur parce qu’ils ont ratifié la convention des Nations unies relative aux droits de l’enfant ou en raison de lois générales.
Some others consider that the principle is effectively in force due to the ratification of the UN Convention on the Rights of the Child or general laws.

Certains d’entre eux ont également adopté une législation spécifique mettant en oeuvre la décision-cadre (Espagne, Lettonie, Portugal, Finlande), alors que d’autres ont transposé cette décision au moyen de la loi ratifiant la convention de 2000 (Danemark et Pays-Bas).
Certain Member States which ratified the 2000 Convention also adopted specific legislation enacting the Framework Decision (Spain, Latvia, Portugal, Finland), whereas others implemented the Framework Decision by means of the law ratifying the 2000 Convention (Denmark and the Netherlands).

Un État membre (Lituanie) n’a transmis que le texte de ses dispositions nationales spécifiques, sans joindre la loi de ratification, et un autre (Estonie) n'a fourni aucune information sur la transposition de la décision-cadre, bien qu’il ait ratifié la convention de 2000.
One Member State (Lithuania) forwarded only the text of specific domestic legislation without annexing the ratifying law, and one (Estonia) did not give any information on implementation, despite having ratified the 2000 Convention.
