42. se félicite de ce que la loi XXXVI de 2013 sur la procédure électorale en Hongrie, en particulier son article 42, prévoit que les personnes handicapées, sur simple demande, puissent bénéficier d'instructions en braille, d'informations pertinentes sous une forme facilement lisible, de bulletins de vote en braille dans les bureaux de vote et d'une accessibilité totale aux bureaux de vote, avec une attention particulière accordée aux personnes en fauteuil roulant, et qu'en outre, les électeurs handicapés peuvent, en vertu de l'article 50 de cette loi, demander leur inscription dans un autre bureau de vote, plus facilement accessible, afin de pouvoir voter dans une circonscription donnée, conformément à l'obligation inscrite à l'article 81 de mettre en place au moins un bureau de vote totalement accessible dans chaque circonscription;

Welcomes the fact that Act XXXVI of 2013 on the election procedure in Hungary, specifically Article 42, prescribes that, upon request, people with disabilities must be provided with instructions in braille, relevant information in easy-to-read form, voting samples in braille at polls, full accessibility of polls, including particular attention to the needs of the wheelchair users; in addition, on the basis of Article 50 of the abovementioned Act, disabled voters can ask to be registered at another, more accessible, polling station in order to cast their votes in the given constituency, in accordance with the obligation to provide at least one fully accessible polling station in every constituency laid down in Article 81;

At paragraph 42 of the judgment under appeal, the General Court observed that neither the Court of Appeal’s judgment of 7 May 2008 nor the Home Secretary’s order of 23 June 2008 had an automatic, immediate effect on Council Decision 2007/868/EC of 20 December 2007 implementing Article 2(3) of Regulation No 2580/2001 and repealing Decision 2007/445/EC (OJ 2007 L 340, p. 100), then applicable, that decision remaining in force and legally binding, in accordance with the presumption of legality attaching to acts of the European Union, for so long as it was not withdrawn, declared void in an action for annulment or declared invalid following a reference for a preliminary ruling or a plea of illegality.
