to welcome the progress made in many areas when the Internal Security Act (ISA) was replaced in July 2012 by the Security Offences Special Measures Act (SOSMA), which has limited the maximum detention period without trial or charge to 28 days; to express disappointment, however, that some provisions of the SOSMA still have shortcomings, for instance as regards the appeal system, which – the changes made notwithstanding – could still result in indefinite detention if bail is not allowed, and the fact that the SOSMA restricts basic rights such as privacy of communications and allows the source of evidence to be concealed, thereby preventing cross-examination during trials;

18. rappelle que la liberté d'expression et le pluralisme des médias, dont l'internet, sont au cœur des valeurs européennes et qu'une société véritablement démocratique réclame une réelle liberté d'expression, y compris le droit à la dissidence; met en exergue le rôle particulier joué par les médias du service public dans le renforcement de la démocratie et demande aux autorités de veiller à leur indépendance, à leur pérennité et à leur respect des normes de l'Union européenne; souligne de nouveau l'importance que revêt l'abolition des dispositions législatives qui imposent aux médias des amendes disproportionnées entraînant, dans certains cas, leur fermeture ou l'autocensure, souligne également la nécessité urgente de réformer la loi sur l'internet; insiste sur l'importance de lutter contre les restrictions des libertés fondamentales dans le contexte plus large de l'état de droit, aussi bien dans les termes de la loi que dans l'application de celle-ci; s'inquiète notamment du fait que le code pénal et la loi sur la lutte contre le terrorisme sont utilisés pour réprimer des déclarations non violentes si celles-ci sont considérées comme un soutien aux objectifs d'une organisation terroriste; souligne la nécessité de modifier les articles 26 et 28 de la constitution, qui restreignent la liberté d'expression au nom de la sécurité nationale, de l'ordre public et de l'unité nationale; invite une fois de plus le gouvernement turc à achever le réexamen du cadre juridique en matière de liberté d'expression et de le mettre au plus tôt en conformité avec la jurisprudence de la Cour européenne des droits de l'homme;

Recalls that freedom of expression and media pluralism, including on the internet, are core European values and that a truly democratic society requires genuine freedom of expression, including the right of dissent; highlights the special role of public-service media in strengthening democracy and calls on the authorities to ensure their independence, sustainability and compliance with European Union standards; underlines, once again, the importance of abolishing legislation providing for disproportionately high administrative tax fines on the media, leading, in some cases, to their closure or to self–censorship, and the urgent need to reform the internet law; stresses the importance of tackling restrictions on fundamental freedoms in the broader context of the rule of law, in terms of both the wording and the application of the law; is concerned, in particular, that the penal code and anti-terror law are used to prosecute non-violent statements when they are perceived as supporting the aims of a terrorist organisation; stresses the need to amend Articles 26 and 28 of the Turkish Constitution, which limit freedom of expression on the basis of national security, public order and national unity; reiterates, therefore, its previous calls to the Government of Turkey to finalise the review of the legal framework on freedom of expression and to bring it, without delay, into line with ECtHR case law;
