La recommandation concernant l'état de droit que la Commission a adressée aujourd'hui à la Pologne concerne quatre actes législatifs désormais adoptés par le parlement polonais qui, selon l'appréciation de la Commission, accroîtront la menace systémique pesant sur l'état de droit. Ces lois concernent respectivement la Cour suprême et le Conseil national de la magistrature (auxquelles le Président de la République a opposé son veto le 24 juillet), l'organisation des juridictions de droit commun (loi signée le 25 juillet par le Président de la République et en attente de publication et d'entrée en vigueur) et l'École nationale de la magistrature (loi publiée et en vigueur depuis le 13 juillet).
The Commission's Rule of Law Recommendation sent today to Poland covers four new legislative acts now adopted by thePolish Parliament which in the Commission's assessment will increase the systemic threat to the rule of law: the Law on the Supreme Court, the Law on the National Council for the Judiciary (both 'vetoed' on 24 July by the President of the Republic), the Law on the Ordinary Courts Organisation (signed by the President of the Republic on 25 July and awaiting publication and entry into force); and the Law on the National School of Judiciary (published and in force since 13 July).

On the basis of an in-depth legal assessment of the Hungarian Higher Education Law, the Commission decided to take legal action and sent a letter of formal notice to the Hungarian Government on the Hungarian Higher Education Law. The Hungarian authorities responded on 25 May.

The new Implementing Law provides that judgments of the Tribunal and decisions of the Tribunal adopted in breach of the Constitutional Tribunal Act of 25 June 2015 or the Constitutional Tribunal Act of 22 July 2016 and issued prior to the date of entry into force of the new Law on organisation and proceedings shall be published in the relevant official gazettes after their publication has been ordered by the acting President of the Tribunal, unless they concern regulatory instruments that have ceased to apply.

10. Deplores the fact that a number of legal provisions such as Articles 301, 318 and 220(6), in combination with Article 314(2), of the Penal Code, and Article 7(2) of the anti-terror law, Law No 5816 of 25 July 1951 – as well as statements by the Government and activities by public prosecutors – continue to limit freedom of expression; reiterates its call to the Government to finalise the review of the legal framework on freedom of expression and, without delay, to bring it into line with the ECHR and the case law of the European Court of Human Rights; restates, in this context, the need for the Turkish Government to issue clear guidance to prosecutors in relation to laws that are frequently used to limit freedom of expression; deplores the repeated and disproportionate recourse to closure of websites and asks the Government to prepare amendments to the internet law (Law No 5651) in order to make sure that it no longer restricts freedom of expression or the right of citizens to access information;
