Loi de police // Notion de droit international de privé qui désigne les normes auxquelles un Etat accorde une importance telle qu'il exige leur application dès lors que la situation juridique présente un lien avec son territoire, quelle que soit par ailleurs la loi applicable à la situation. Contrairement au mécanisme de l'exception d'ordre public international*, le juge n'écarte pas la loi désignée par ses règles de conflit* au motif de leur contrariété à l'ordre public, mais applique d'office ses propres règles.

La recommandation concernant l'état de droit que la Commission a adressée aujourd'hui à la Pologne concerne quatre actes législatifs désormais adoptés par le parlement polonais qui, selon l'appréciation de la Commission, accroîtront la menace systémique pesant sur l'état de droit. The Commission's Rule of Law Recommendation sent today to Poland covers four new legislative acts now adopted by thePolish Parliament which in the Commission's assessment will increase the systemic threat to the rule of law: the Law on the Supreme Court, the Law on the National Council for the Judiciary (both 'vetoed' on 24 July by the President of the Republic), the Law on the Ordinary Courts Organisation (signed by the President of the Republic on 25 July and awaiting publication and entry into force); and the Law on the National School of Judiciary (published and in force since 13 July).

E. whereas more than 800 civilians have been referred to military prosecutors on the basis of Law 136; whereas the retroactive application of the law is contrary to the Egyptian Constitution´s Article 95, which stipulates that penalties can be applied only for acts committed after the effective date of the law imposing them; whereas the African Commission on Human and People´s Rights, interpreting the African Charter on Human and People´s Rights, to which Egypt is a state party, has said that military courts should not, in any circumstances whatsoever, have jurisdiction over civilians; whereas Article 93 of the Egyptian Constitution stipulates that the international human rights agreements and conventions to which Egypt is a state party have the force of law; whereas, therefore, President al-Sisi´s October 2014 decree, Law 136, is unconstitutional;

9. invite les autorités égyptiennes à annuler la loi de protestation de novembre 2013 et à s'engager dans un véritable dialogue avec les organisations de la société civile et des experts juridiques afin d'adopter une loi sur les associations et la réunion, conformément aux normes internationales, et à sauvegarder le droit de former une association consacré par l'article 75 de la constitution égyptienne, y compris le droit de recevoir et de distribuer des fonds; invite les autorités compétentes à examiner le nouveau projet de loi sur les organisations non gouvernementales présenté par le ministère de la solidarité sociale; demande instamment que la nouvelle loi proposée soit conforme à la constitution égyptienne et à tous les traités internationaux auxquels l'Égypte est signataire;
9. Calls on the Egyptian authorities to revoke the Protest Law of November 2013 and to engage in a genuine dialogue with civil society organisations and legal experts in order to enact legislation on associations and assembly in line with international standards, and to safeguard the right to form an association enshrined in Article 75 of the Egyptian Constitution, including the right to receive and impart funding; calls on the competent authorities to review the new draft law for non-governmental organisations presented by the Ministry of Social Solidarity; urges that the proposed new law should be in line with the Egyptian Constitution and with all international treaties to which Egypt is a signatory;

AJ. considérant que des lois importantes, notamment la Loi fondamentale, ses deuxième et quatrième amendements, les dispositions transitoires de la Loi fondamentale et un certain nombre de lois cardinales, ont été adoptées sur la base de propositions de loi d'initiative parlementaire individuelle, des propositions auxquelles les règles établies dans la loi CXXXI de 2010 sur la participation de la société civile à la préparation de la législation, ainsi que dans le décret n° 24 de 2011 du ministre de l'administration publique et de la justice sur une analyse d'impact préliminaire et ex post ne s'appliquent pas, ce qui a pour conséquence que les lois adoptées selon cette procédure simplifiée font l'objet d'un débat public restreint;
AJ. whereas important legislation, including the Fundamental Law, the second and fourth amendments thereto, the Transitional Provisions of the Fundamental Law and a number of cardinal laws, were enacted on the basis of individual members’ bills, to which the rules set out in Act CXXXI of 2010 on the participation of civil society in the preparation of legislation and in Decree 24/2011 of the Minister of Public Administration and Justice on preliminary and ex‑post impact assessment do not apply, with the consequence that legislation adopted through this streamlined procedure is subject to a restricted public debate;

In a situation involving a conflict of laws, where the law applicable to the sales or service contract is determined in accordance with Article 6(1) and (2) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I) , the solution imposed by the ADR entity should not result in the consumer being deprived of the protection afforded to him by the provisions that cannot be derogated from by agreement by virtue of the law of the Member State in which the consumer is habitually resident.
