88. Welcomes the legal status of same-sex relationships in Mali, Niger, Chad and Burkina Faso; regrets, however, the societal discrimination still present; expresses its grave concern over the use of ‘public indecency’ laws and laws prohibiting association for ’an immoral purpose’ when dealing with the LGBT community in Mali and the wider region; hopes that those oppressed during the insurgency in northern Mali may safely re-integrate into their society; expresses deep concern over the continuing criminalisation of LGBT relationships in Mauritania which, for men, nominally carry the punishment of death by public stoning; notes, however, that there are no documented incidences of this punishment ever having been applied; urges the Mauritanian Government, nevertheless, to work with civil society to reform its legislation and help to improve the lives of LGBT citizens;

(13 bis) Toutefois, afin de permettre aux bénéficiaires de jouir dans un autre État membre des droits qui ont été créés ou leur ont été transférés, par exemple dans le cadre d'un litige relatif à un régime matrimonial, il convient que le présent règlement prévoie l'adaptation d'un droit réel inconnu à son équivalent le plus proche en vertu du droit de cet autre État membre. Dans le cadre de cette adaptation, il y a lieu de tenir compte des objectifs et des intérêts poursuivis par le droit réel en question et des effets qui y sont liés. Pour déterminer l'équivalent le plus proche du droit réel en droit national, les autorités ou les personnes compétentes de l'État dont la loi s'applique au régime matrimonial pourront être contactées afin d'obtenir des informations complémentaires sur la nature et les effets de ce droit. À cette fin, il serait possible d'avoir recours aux réseaux existants dans le domaine de la coopération judiciaire en matière civile et commerciale, ainsi qu'à tout autre moyen disponible permettant de comprendre plus facilement la loi étrangère (Correspond au considérant 16 du règlement (UE) n° 650/2012)
(13a) However, in order to allow the beneficiaries to enjoy in another Member State the rights which have been created or transferred to them, for example in the context of a dispute concerning a matrimonial property regime, this Regulation should provide for the adaptation of an unknown right in rem to the closest equivalent right in rem under the law of that other Member State. In the context of such an adaptation, account should be taken of the aims and the interests pursued by the specific right in rem and the effects attached to it. For the purposes of determining the closest equivalent national right in rem, the authorities or competent persons of the State whose law applies to the matrimonial property regime may be contacted for further information on the nature and the effects of the right. To that end, the existing networks in the area of judicial cooperation in civil and commercial matters could be used as well as any other available means facilitating the understanding of foreign law (Corresponds to recital 16 in Regulation (EU) No 650/2012.)

Les dispositions du présent règlement ne pourront porter atteinte à l'application des dispositions impératives dont le respect est jugé crucial par un État membre pour la sauvegarde de ses intérêts publics, tels que son organisation politique, sociale ou économique, au point d'en exiger l'application à toute situation entrant dans son champ d'application, quelle que soit par ailleurs la loi applicable au régime matrimonial d'après le présent règlement .
The provisions of this Regulation shall be without prejudice to the application of imperative provisions the upholding of which is regarded as crucial by a Member State for safeguarding its public interests, such as its political, social or economic organisation, to such an extent that they are applicable to any situation falling within their scope, irrespective of the law otherwise applicable to the matrimonial property regime under this Regulation.

Dès lors, ne pourront être considérées comme des dispositions spéciales prévoyant des restrictions concernant la succession dans le cas de certains biens ou ayant une incidence sur celle-ci ni les règles de conflit de lois soumettant les biens immobiliers à une loi différente de celle applicable aux biens mobiliers, ni les dispositions prévoyant une réserve héréditaire plus importante que celle prévue par la loi applicable à la succession en vertu du présent règlement.
Therefore, neither conflict of laws rules subjecting immovable property to a law different from that applicable to movable property nor provisions providing for a reserved share of the estate greater than that provided for in the law applicable to the succession under this Regulation may be considered as special rules setting restrictions concerning or affecting the succession in respect of certain assets.

2. Les dispositions du présent règlement ne pourront porter atteinte à l'application des lois de police du juge saisi.
