The European Parliament considers that the following Recital 32a and Article 5a ought to be added to Regulation (EC) No 864/2007 on the law applicable to non-contractual obligations (Rome II):

1. demande à la Commission de soumettre, sur la base de l'article 81, paragraphe 2, point c), du traité sur le fonctionnement de l'Union européenne, une proposition visant à ajouter au règlement Rome II une disposition régissant la loi applicable aux obligations non contractuelles résultant d'atteintes à la vie privée et aux droits de la personnalité, y compris la diffamation, suivant les recommandations détaillées figurant en annexe;
1. Requests the Commission to submit, on the basis of point (c) of Article 81(2) of the Treaty on the Functioning of the European Union, a proposal designed to add to the Rome II Regulation a provision to govern the law applicable to a non-contractual obligation arising out of violations of privacy and rights relating to personality, including defamation, following the detailed recommendations set out in the annex hereto;

2. souhaite que le nouveau plan déchets présenté il y a peu par la région de Campanie à la Commission respecte les obligations imposées par la loi et rappelées dans l'arrêt de la Cour de justice dans l'affaire C-297/08, et soit conforme aux dispositions communautaires (particulièrement les directives n° 2006/12/CE avec modifications et ajouts ultérieurs, et n° 1999/31/CE avec modifications et ajouts ultérieurs) et invite la Commission à procéder à des vérifications méticuleuses à cet égard;
2. Hopes that the new waste plan which the Campania Region recently presented to the Commission complies with the legal obligations referred to in the judgment of the Court of Justice in Case C-297/08 and will prove to accord with Community law (particularly Directives 2006/12/EC and 1999/31/EC, both as subsequently amended and supplemented), and calls on the Commission to consider the matter carefully;
