TRADUCTIONS EN CONTEXTE

(1 bis) Dans sa résolution du 8 juin 2011 intitulée "Investir dans l’avenir: un nouveau cadre financier pluriannuel (CFP) pour une Europe compétitive, durable et inclusive", le Parlement européen a rappelé que, en l'absence de ressources supplémentaires suffisantes dans le CFP de l'après-2013, l'Union ne sera en mesure ni de mettre en œuvre les orientations prioritaires actuelles, notamment liées à la stratégie Europe 2020, ni de s'acquitter des nouvelles missions que lui assigne le traité de Lisbonne, ni, à plus forte raison, de faire face aux événements imprévus; il soulignait que même une augmentation de 5 % du niveau des ressources affectées au prochain CFP par rapport au niveau de 2013 ne permettrait que partiellement de contribuer à la réalisation des objectifs et des engagements fixés par l'Union et au respect du principe de solidarité de l'Union; il pressait le Conseil, au cas où celui-ci ne partagerait pas cette approche, d'indiquer clairement quels priorités ou projets politiques pourraient être purement et simplement abandonnés, malgré leur valeur ajoutée européenne avérée.
(1a) In its resolution of 8 June 2011 on Investing in the future: a new Multiannual Financial Framework (MFF) for a competitive, sustainable and inclusive Europe, the European Parliament reiterated that without sufficient additional resources in the post-2013 MFF, the Union will not be able to fulfil its existing policy priorities, namely linked to the EU2020 strategy, and the new tasks provided for in the Treaty of Lisbon, as well as to respond to unforeseen events; it pointed out that, even with an increase in the level of resources for the next MFF of at least 5 % compared to the 2013 level, only a limited contribution can be made to the achievement of the Union's agreed objectives and commitments and the principle of Union solidarity; it challenged the Council, if it does not share this approach, to clearly identify which of its political priorities or projects could be dropped altogether, despite their proven European added value.

3. rappelle que, dans sa résolution du 20 février 2008 sur la contribution au Conseil européen de printemps 2008 en relation avec la stratégie de Lisbonne , il soulignait déjà à quel point il était indispensable de sauvegarder la stabilité des marchés financiers, constatait que la récente crise des subprimes montrait la nécessité pour l'Union européenne de mettre en place des mesures de surveillance afin de renforcer la transparence et la stabilité des marchés financiers et de mieux protéger les clients, demandait une évaluation des systèmes et instruments de surveillance prudentielle en place en Europe et demandait instamment une étroite concertation avec le Parlement, débouchant sur des recommandations claires quant aux moyens d'améliorer la stabilité du système financier et sa capacité à assurer des finances sûres à long terme aux entreprises européennes;

Recalls that, in its resolution of 20 February 2008 on the input for the 2008 Spring Council as regards the Lisbon Strategy , Parliament already pointed to the overriding importance of safeguarding the stability of financial markets, noted that the recent subprime crisis shows the need for the European Union to develop oversight measures in order to strengthen the transparency and stability of the financial markets and better protect customers, requested an evaluation of the current systems and instruments of prudential supervision in Europe and insisted on close consultation with Parliament, leading to clear recommendations on how to improve the stability of the financial system and its ability to provide secure long-term finance for European business;

La lettre soulignait que la Commission s'était appuyée sur une base juridique dérivée qui, en substance, semble illicite au regard de la jurisprudence établie par la Cour de justice (notamment dans l'arrêt rendu le 6 mai 2008 dans l'affaire C-133/06, et constatait par ailleurs que, en vertu du traité de Lisbonne, la fonction législative est désormais partagée entre le Parlement et le Conseil et que, dans la mesure où l'article 202 du traité CE a été abrogé, le Conseil ne dispose plus de compétences législatives autonomes. C'est la procédure législative ordinaire qui, aux termes de l'article 43, paragraphe 2, du traité FUE, s'applique à l'adoption des actes législatifs visant le domaine de l'agriculture.
The letter stressed that the Commission had used a secondary legal basis, which ‘(...) seems to be illegal in the light of the case law of the Court of Justice (in particular its judgment of 6 May 2008 in case C-133/06)’ and further stated that ‘(...) under the Treaty of Lisbon, the legislative function is now shared between Parliament and the Council and, as Article 202 EC has been repealed, the Council no longer has an autonomous legislative power. With regard to legislative acts in the field of agriculture under Article 43(2) TFEU, it is the ordinary legislative procedure which applies to their adoption’.

the new strategic goal set for the European Union by the Lisbon European Council of 23-24 March 2000 and reaffirmed by the Stockholm European Council of 23 and 24 March 2001, "to become the most competitive and dynamic knowledge-based economy in the world, capable of sustainable economic growth, with more and better jobs and greater social cohesion"; the conclusions of the Spring 2005 European Council, which underline that "human capital is Europe's most important asset" ; the Lisbon European Council's affirmation that Europe's education and training systems need to adapt both to the demands of the knowledge society and to the need for a higher level and quality of employment.
