3.2.7 The Member States were asked whether they believed that there was a case for moving some projects from Annex II to Annex I. However, the largest single proportion of respondents felt that there is no case for moving projects from Annex II to Annex I (i.e. Austria, Denmark, Greece, Netherlands, Spain, Sweden, UK). Thirdly, nor is it possible to accept the applicant’s arguments that he should have been recruited at a higher grade because, first, the post he occupied as a seconded national expert was regarded as ‘sensitive’ in the light of his job description, due to the particular skills required, and his functions remained exactly the same when he was appointed as a temporary agent in grade AD 5; secondly, because in December 2012 his job description was the same as those of the two other members of the same team who were officials, one in grade AD 12 and the other in grade AD 13; and, thirdly, because he was engaged as a temporary agent and recruited at grade AD 5, whilst his predecessor had been an official in grade AD 13.

Thus, the Civil Service Tribunal disregarded, in the first place, the case-law according to which the statement of reasons for the decision rejecting a complaint is deemed to supplement the statement of reasons for the decision against which the complaint was directed (see, to that effect, Case T-562/93 Obst v Commission [1995] ECR-SC I-A-247 and II-737, paragraph 79, and Case T-71/96 Berlingieri Vinzek v Commission [1997] ECR-SC I-A-339 and II-921, paragraph 79), in the second place, the principle of legality, according to which the reasons for a decision may be based only on factors which predate or are contemporaneous with it, and, in the third place, the purpose of the pre-litigation procedure consisting in giving the parties the possibility of finding an amicable solution to the dispute (Case T-86/98 Gouloussis v Commission [2000] ECR-SC I-A-5 and II-23, paragraph 61).

First, the decision was not based on “technical or scientific progress”, since the draft conclusions of the risk assessment used to justify the exemption dated from 2002 and the conclusions had not changed since then; secondly, the Commission did not assess whether or not substitutes are available and what are the impacts of the substitutes compared to Deca-BDE; thirdly, the exemption was too wide.
