It calls on the Commission to deliver the requested explanation as to how it can ensure in current and future legislation that persons with disabilities are guaranteed equal opportunities, fundamental rights, equal access to services and the employment market, and the same rights and obligations in accessing social security as nationals of the Member State in which they are covered, in line with the principle of equal treatment and non-discrimination, so that all persons with disabilities can enjoy the right to free movement held by all EU citizens;

National administrators, the central administrator and the Commission should comply with Union and national legislation concerning the protection of individuals with regard to the processing of personal data and on the free movement of such data, in particular Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the national law implementing it, and Regulation (EC) No 45/2001 of the European Parliament and of the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data , where these are applicable to information held and processed pursuant to this Regulation for which they are the controllers.

The legal framework governing the privatisation of Portugal Telecom provided for privileged shares (A-shares), the majority of which were to be held by the State/public entities. Although the number of A-shares was reduced during the successive privatisation phases, the corresponding privileges, as defined in the Articles of Association of the Company, were maintained. These privileges include special power to appoint one third of the board and the chairman of the company and several veto powers on resolutions on the election of Directors and the audit board; decisions on profit distributions; capital increases; bond issues; opening of branches and changes in the registered office; changes in the Articles of Association; approval of holdings - by shareholders engaged in a competing activity - above 10% of the company's ordinary shares. The Commission is concerned that, in violation of EC Treaty rules (Article 56-Free movement of capital and Article 43-Right of Establishment), these special powers constitute an unjustified restriction on the free movement of capital and the right of establishment, in so far as they hinder both direct investment and portfolio investment.

Par contre, la Commission a formellement classé la procédure d'infraction contre la France au sujet de l'action spécifique détenue par la France dans la Société nationale Elf-Aquitaine, vu les mesures prises par la république française pour se conformer à un autre arrêt de la Cour du 4 juin 2002, par lequel cette action spécifique a été déclarée incompatible avec les mêmes dispositions du Traité sur la libre circulation des capitaux.
On the other hand, the infringement proceedings against France regarding its special shareholding (golden share) in Société Nationale Elf-Aquitaine have been formally closed by the Commission, in view of the measures taken by France to comply with a ruling of the Court, also of 4 June 2002, finding the special shareholding to be incompatible with the same provisions of the Treaty on the free movement of capital.
