Trois mesures ont déjà été adoptées: en octobre 2010, la directive 2010/64/UE du Parlement européen et du Conseil relative au droit à l’interprétation et à la traduction dans le cadre des procédures pénales[2]; en mai 2012, la directive 2012/13/UE du Parlement européen et du Conseil relative au droit à l’information dans le cadre des procédures pénales[3] et, en octobre 2013, la directive 2013/48/UE du Parlement européen et du Conseil relative au droit d’accès à un avocat dans le cadre des procédures pénales et des procédures relatives au mandat d’arrêt européen, au droit d'informer un tiers dès la privation de liberté et au droit des personnes privées de liberté de communiquer avec des tiers et avec les autorités consulaires[4]. Des mesures relatives à la protection des personnes vulnérables soupçonnées ou poursuivies dans le cadre de procédures pénales sont présentées sous la forme d'un paquet législatif, comprenant la présente initiative, ainsi qu’une directive portant renforcement de certains aspects de la présomption d’innocence et du droit d’assister à son procès dans le cadre des procédures pénales, qui font partie des principes fondamentaux qui sous-tendent le droit à un procès équitable.
3. Three measures have already been adopted: a Directive 2010/64/EU of the European Parliament and of the Council on the right to interpretation and translation in criminal proceedings[2] in October 2010 and Directive 2012/13/EU of the European Parliament and of the Council on the right to information in criminal proceedings in May 2012[3], and Directive 2013/48/EU of the European Parliament and of the Council on the right of access to a lawyer in criminal proceedings and in European arrest warrant proceedings, and on the right to have a third party informed upon deprivation of liberty and to communicate with third persons and with consular authorities while deprived of liberty in October 2013.[4] Measures on the protection of vulnerable persons suspected or accused in criminal proceedings are presented as a package with the present initiative, together with a Directive on the strengthening of certain aspects of the presumption of innocence and of the right to be present at trial in criminal proceedings, which form part of the underlying principles of the right of fair trial.

The Member State may refuse to respond to the request submitted to it, if the communication of such information is likely to harm the essential interests of the Member State or the protection of the liberties and fundamental rights of the person concerned or of others.

Si un mandat d’arrêt européen est délivré aux fins de l’exécution d’une peine ou d’une mesure de sûreté privatives de liberté et si l’intéressé n’a pas été officiellement informé auparavant de l’existence de poursuites pénales à son encontre et que le jugement ne lui a pas été signifié, l’intéressé devrait recevoir, à la suite d’une demande présentée dans l’État membre d’exécution, une copie du jugement pour information uniquement.
In case a European arrest warrant is issued for the purpose of executing a custodial sentence or detention order and the person concerned has not previously received any official information about the existence of the criminal proceedings against him or her, nor has been served with the judgment, this person should, following a request in the executing Member State, receive a copy of the judgment for information purposes only.

Therefore, the United Kingdom declares that it intends to exercise its right under Article 3 of the Protocol on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice to take part in the adoption of all proposals made under Article 75 of the Treaty on the Functioning of the European Union.
