As regards the offences of passive corruption and misappropriation, there is a need to include a definition of public officials covering all relevant officials, whether appointed, elected or employed on the basis of a contract, holding a formal office, as well as persons exercising the function of providing service from government and other public bodies to citizens, or for the public interest in general, without holding a formal office, such as contractors involved in the management of EU funds.

Conformément au règlement (UE) no 216/2013 du Conseil du 7 mars 2013 relatif à la publication électronique du Journal officiel de l’Union européenne (JO L 69 du 13.3.2013, p. 1), à compter du 1er juillet 2013, seul le Journal officiel publié sous forme électronique fait foi et produit des effets juridiques.
In accordance with Council Regulation (EU) No 216/2013 of 7 March 2013 on the electronic publication of the Official Journal of the European Union (OJ L 69, 13.3.2013, p. 1), as of 1 July 2013, only the electronic edition of the Official Journal shall be considered authentic and shall have legal effect.

Competent authorities shall send to the Office for Official Publications of the European Communities, by the most appropriate channels, notices and decisions relating to public service contracts and compensation schemes having an estimated annual value of, respectively, EUR 400 000 or more, or EUR 800 000 or more, for publication in the Official Journal of the European Communities.

Les autorités compétentes envoient à l'Office des publications officielles des Communautés européennes, par les voies les mieux adaptées, les avis et les décisions portant sur les contrats de service public et les régimes d'indemnisation dont la valeur annuelle est estimée respectivement à 1 000 000 euros ou plus, ou à 3 000 000 euros ou plus pour qu'ils soient publiés au Journal officiel des Communautés européennes.
