(2) Subject to subsection (3), the amount for which an operator is liable to Her Majesty under subsection (1) shall be paid to Her Majesty by the operator in accordance with demands therefor made by the Minister to the operator, and in the event of failure by the operator to pay any amount so demanded, the approved insurer with whom the insurance referred to in subsection (1) was maintained is liable to Her Majesty for that amount.

(6 sexies) Pour réaliser l'objectif légitime consistant à assurer la sécurité publique en perturbant le moins possible le bon fonctionnement du marché intérieur, il convient de prévoir un système d'octroi de licences selon lequel un membre du grand public ayant acquis une substance mentionnée à l'annexe I, ou encore un mélange ou une substance contenant ladite substance, à une concentration supérieure à celle prévue à ladite annexe, puisse l'introduire depuis un autre État membre ou un État tiers dans un État membre qui autorise l'accès à ces substances conformément à un des systèmes prévus dans le présent règlement.
(6e) In order to achieve legitimate objectives of public security whilst at the same time ensuring the least disruption to the smooth functioning of the internal market, it is appropriate to provide for a licensing system in accordance with which a member of the general public, who has acquired a substance listed in Annex I, or mixture or substance containing that substance, in a concentration above that laid down in that Annex would be able to introduce it from another Member State or a third country into a Member State which allows access to those substances in accordance with any of the systems provided for in this Regulation.
