Revision of the amount of reduction shall be on the first or only date in every year, beginning on or after 1 January 1978, on which the said retirement pension under the legislation of the United Kingdom is increased in accordance with an up-rating order, and the amount of reduction shall be a sum equal to the weekly rate of the said old age security pension payable in respect of the week in which that day falls as converted into the sterling equivalent at the rate of exchange obtaining on that day.

(5) Where the pension of a successor is to be or is being reduced under this section for a term and the successor, being the widow of a former contributor, remarries before the end of the term and the pension is suspended, if at any time the pension is resumed it shall be reduced for a term equal to the term or the balance of the term, as the case may be, during which the pension would have been reduced had it not been suspended and such reduction shall be made to the same extent and in the same manner as the pension was reduced immediately prior to the suspension.

3. Sous réserve des dispositions de l’article 9, aux fins d’une demande de pension payable à une veuve, la personne qui demande ladite prestation est réputée justifier d’une période admissible canadienne équivalente à toute période admissible dont justifie son conjoint décédé aux termes du Régime de pensions du Canada, sauf que toute période pour laquelle ladite personne et son conjoint décédé justifient tous deux d’une période admissible aux termes du Régime de pensions du Canada n’est considérée qu’une seule fois.
3. For the purposes of a claim by a person for a pension payable to a widow, that person shall, subject to Article 9, be deemed to have accumulated a Canadian creditable period for any period for which her spouse accumulated a creditable period under the Canada Pension Plan but any period during which the person and her spouse both accumulated Canadian creditable periods under the Canada Pension Plan shall be taken into account once only.

For the purposes of a claim by a person for a pension payable to a widowed person, that person shall be deemed to have accumulated a Canadian creditable period for any period for which the person’s partner accumulated a creditable period under the Canada Pension Plan but any period during which the person and the partner both accumulated Canadian creditable periods under the Canada Pension Plan shall be taken into account once only.

Dans l’affirmative, le mémorandum du 23 juin 2009 d’entente entre la Communauté européenne et la Roumanie, publié au Monitorul Oficial no 455 du 1er juillet 2009, doit-il être interprété en ce sens que, en vue de la réduction des effets de la crise économique par la réduction des frais de personnel, la Commission européenne peut valablement imposer l’adoption d’une loi nationale privant une personne de son droit de percevoir la pension contributive pour plus de 30 ans de cotisations, fixée conformément à la loi et perçue antérieurement à ladite loi, au motif que cette personne perçoit un salaire pour une activité exercée au titre d’un contrat de travail, différente de celle pour laquelle elle a été mise à la retraite?
If the answer is in the affirmative, is the Memorandum of Understanding between the European Community and Romania of 23 June 2009, published in Monitorul Oficial No 455 of 1 July 2009, to be interpreted as allowing the European Commission to require, for the purposes of reducing the effects of the economic crisis by reducing staff costs, the adoption of a national law which withdraws a person’s right to receive a contributory pension accrued over more than 30 years, which was legally established and received before that law came into force, on the ground that the person in question receives a salary for activity, carried out on the basis of an employment contract, other than the activity in respect of which he receives the pension?

Conformément au principe de proportionnalité et au principe de base selon lequel le présent règlement doit s'appliquer à tous les citoyens de l'Union européenne, ainsi que dans le souci de trouver une solution qui tienne compte des contraintes pouvant résulter des caractéristiques particulières des systèmes fondés sur la résidence, il est jugé opportun de prévoir une dérogation particulière pour le Danemark par le biais d'une annexe XI – DANEMARK. En effet, cette dérogation, qui est limitée au droit à la pension sociale uniquement pour la nouvelle catégorie de «personnes non actives» à laquelle s'étend le présent règlement, se justifie par les caractéristiques particulières du système en vigueur au Danemark et par le fait que ladite pension est exportable après dix ans de résidence en vertu de la législation danoise en vigueur (loi sur les pensions).
In line with the principle of proportionality, in accordance with the premise for the extension of this Regulation to all European Union citizens and in order to find a solution that takes account of any constraints which may be connected with the special characteristics of systems based on residence, a special derogation by means of an Annex XI — ‘DENMARK’ entry, limited to social pension entitlement exclusively in respect of the new category of non-active persons, to whom this Regulation has been extended, was deemed appropriate due to the specific features of the Danish system and in the light of the fact that those pensions are exportable after a 10-year period of residence under the Danish legislation in force (Pension Act).

In line with the principle of proportionality, in accordance with the premise for the extension of this Regulation to all European Union citizens and in order to find a solution that takes account of any constraints which may be connected with the special characteristics of systems based on residence, a special derogation by means of an Annex XI - "DENMARK" entry, limited to social pension entitlement exclusively in respect of the new category of non-active persons, to whom this Regulation has been extended, was deemed appropriate due to the specific features of the Danish system and in the light of the fact that those pensions are exportable after a ten-year period of residence under the Danish legislation in force (Pension Act).

En cas de décès du titulaire d'une pension ou d'une rente due au titre de la législation d'un État membre ou de pensions ou de rentes dues au titre des législations de deux ou plusieurs États membres, lorsque ce titulaire résidait sur le territoire d'un État membre autre que celui où se trouve l'institution à laquelle incombait la charge des prestations en nature servies audit titulaire en vertu des dispositions de l'article 28, les allocations de décès dues au titre de la législation que cette institution applique sont servies par ladite institution et à sa charge, comme si le titulaire résidait, au moment de son décès, sur le territoire de l'État membre où elle se trouve.
In the event of the death of a pensioner who was entitled to draw a pension or pensions under the legislation of one or more Member states, when such pensioner was residing in the territory of a Member States other than the one whose institution was responsible for providing him with benefits in kind under Article 28, the death grants payable under the legislation administrated by that instituion shall be provided by the institution at its own expense as though the pensioner had been residing in the territory of the Member States of that institution at the time of his death.
