Au regard de l’article 4, paragraphe 2, lu en combinaison avec l’article 5, paragraphe 3, du traité sur l’Union européenne, une entité organisationnelle communale (collectivité locale de Pologne) peut-elle être qualifiée d’assujettie à la TVA dès lors qu’elle exerce des activités en une qualité autre que celle d’autorité publique au sens de l’article 13 de la directive 2006/112 du Conseil, du 28 novembre 2006, relative au système commun de taxe sur la valeur ajoutée (1), bien qu’elle ne remplisse pas la condition d’autonomie (d’indépendance) que prévoit l’article 9, paragraphe 1, de ladite directive?
In the light of Article 4(2), in conjunction with Article 5(3), of the Treaty on European Union, may an organisational entity of a municipality (a local government body in Poland) be regarded as a taxable person for purposes of VAT when it engages in activities other than as a public authority within the meaning of Article 13 of Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax, (1) notwithstanding the fact that it does not satisfy the criterion of autonomy (independence) set out in Article 9(1) of that directive?

Les fonctionnaires et les agents temporaires occupant un poste dans une entité organisationnelle qui est transférée du Secrétariat général du Conseil ou de la Commission au service européen d’action extérieure (SEAE) conformément à la décision 2010/427/UE, sont réputés transférés des institutions concernées au SEAE à la date prévue à l’article 7 de ladite décision.
