Where an operator has submitted information pursuant to Article 24 of Commission Decision 2011/278/EU of 27 April 2011 determining transitional Union-wide rules for harmonised free allocation of emission allowances pursuant to Article 10a of Directive 2003/87/EC of the European Parliament and of the Council that affects the number of allowances to be allocated to that operator, the allocation of the operator will need to be recalculated and notified pursuant to Article 24(2) of that Decision before a transfer of the allowances to the operator can occur pursuant to Article 53(2) of this Regulation.

Article 25(1) of the Convention implementing the Schengen Agreement of 14 June 1985 between the Governments of the States of the Benelux Economic Union, the Federal Republic of Germany and the French Republic on the gradual abolition of checks at their common borders, signed at Schengen on 19 June 1990 and which entered into force on 26 March 1995 must be interpreted as meaning that it is open to the Contracting State which intends to issue a return decision accompanied by a ban on entry and stay in the Schengen Area to a third-country national who holds a valid residence permit issued by another Contracting State to initiate the consultation procedure laid down in that provision even before the issue of the return decision. Le 12 février 2015, le Conseil a adopté la décision (PESC) 2015/236 (3) modifiant la décision 2010/413/PESC afin de prolonger jusqu'au 30 juin 2015 la dérogation prévue à l'article 20, paragraphe 14, de ladite décision, concernant les actes et opérations effectués à l'égard des entités énumérées dans la mesure où ils sont nécessaires à l'exécution des obligations prévues dans les contrats conclus avant le 23 janvier 2012 ou dans les contrats accessoires nécessaires à l'exécution de ces obligations lorsque la fourniture de pétrole brut et de produits pétroliers iraniens ou du produit de la fourniture de ces produits sert au remboursement d'encours relatifs à des contrats conclus avant le 23 janvier 2012 à des personnes ou entités établies sur le territoire des États membres ou relevant de leur juridiction, dès lors que ces contrats prévoient explicitement ces remboursements.
On 12 February 2015, the Council adopted Decision (CFSP) 2015/236 (3) amending Decision 2010/413/CFSP in order to extend, until 30 June 2015, the exemption provided for in Article 20(14) of that Decision concerning acts and transactions carried out with regard to listed entities in so far as necessary for the execution of obligations provided for in contracts concluded before 23 January 2012 or in ancillary contracts necessary for the execution of such obligations where the supply of Iranian crude oil and petroleum products or the proceeds derived from their supply are for the reimbursement of outstanding amounts with respect to contracts concluded before 23 January 2012 to persons or entities within the territories of Member States or under their jurisdiction, where those contracts specifically provide for such reimbursements.

Il ne sera pas soulevé d’objection si un État membre modifie les quantités annuelles totales provisoires de quotas d’émission allouées à titre gratuit aux installations situées sur son territoires qui figurent sur les listes visées au paragraphe 1 et qui sont énumérées à l’annexe I, point C, de la présente décision avant de déterminer la quantité annuelle totale définitive pour la période 2013-2020 conformément à l’article 10, paragraphe 9, de la décision 2011/278/UE, pour autant que la modification consiste à rendre l’allocation conforme aux dispositions de l’article 10, paragraphe 2, point a), de la décision 2011/278/UE et à exclure toute allocation pour les procédés couverts par les limites du système du référentiel de produit de la fonte liquide telle que définie à l’annexe I de ladite décision à une installation qui importe de la fonte liquide mais n’en produit pas, ce qui aurait pour effet d’entraîner un double comptage.
No objections are raised should a Member State amend the preliminary total annual amounts of emission allowances allocated free of charge to installations in its territory included in the lists referred to in paragraph 1 and listed in point C of Annex I to this Decision before determining the final total annual amount for each year from 2013 to 2020 in accordance with Article 10(9) of Decision 2011/278/EU to the extent that the amendment consists of bringing the allocation in line with Article 10(2)(a) of Decision 2011/278/EU and excluding any allocation for processes that are covered by the system boundaries of the product benchmark for hot metal as defined in Annex I to Decision 2011/278/EU to an installation not producing, but importing hot metal that would otherwise lead to double counting.

2. Il ne sera pas soulevé d’objection si un État membre modifie les quantités annuelles totales provisoires de quotas d’émission présentées pour les installations situées sur son territoire qui figurent sur les listes visées au paragraphe 1 et qui sont énumérées à l’annexe I, point A, de la présente décision avant de déterminer la quantité annuelle totale définitive pour la période 2013-2020 conformément à l’article 10, paragraphe 9, de la décision 2011/278/UE, pour autant que la modification consiste à exclure toute augmentation du nombre de quotas qui n’est pas prévue par ladite présente décision.
2. No objections are raised should a Member State amend the preliminary total annual amounts of emission allowances submitted for the installations in its territory included in the lists referred to in paragraph 1 and listed in point A of Annex I to this Decision before determining the final total annual amount for each year from 2013 to 2020 in accordance with Article 10(9) of Decision 2011/278/EU to the extent that the amendment consists of excluding any increase in allocation that is not provided for in that Decision.
