Whereas in and by section 27 of the Canada-Barbados Income Tax Agreement Act, 1980, assented to on December 17, 1980, being Part IX of chapter 44 of the Statutes of Canada, 1980-81, it is provided that notice of the day the Agreement between Canada and Barbados for the avoidance of double taxation and the prevention of fiscal evasion with respect to taxes on income and on capital, set out in Schedule IX to the said Act, comes into force shall be given by proclamation of the Governor in Council published in the Canada Gazette;

(a) Currency of any member listed in Part II of Schedule A, whether or not freely convertible, received by the Association pursuant to Article II, Section 2(d), in payment of the ninety percent portion payable thereunder in the currency of such member, and currency of such member derived therefrom as principal, interest or other charges, may be used by the Association for administrative expenses incurred by the Association in the territories of such member and, insofar as consistent with sound monetary policies, in payment for goods and services produced in the territories of such member and required for projects financed by the Association and located in such territories; and in addition when and to the extent justified by the economic and financial situation of the member concerned as determined by agreement between the member and the Association, such currency shall be freely convertible or otherwise usable for projects financed by the Association and located outside the territories of the member.

Il ne sera pas soulevé d’objection si un État membre modifie les quantités annuelles totales provisoires de quotas d’émission allouées à titre gratuit aux installations situées sur son territoires qui figurent sur les listes visées au paragraphe 1 et qui sont énumérées à l’annexe I, point C, de la présente décision avant de déterminer la quantité annuelle totale définitive pour la période 2013-2020 conformément à l’article 10, paragraphe 9, de la décision 2011/278/UE, pour autant que la modification consiste à rendre l’allocation conforme aux dispositions de l’article 10, paragraphe 2, point a), de la décision 2011/278/UE et à exclure toute allocation pour les procédés couverts par les limites du système du référentiel de produit de la fonte liquide telle que définie à l’annexe I de ladite décision à une installation qui importe de la fonte liquide mais n’en produit pas, ce qui aurait pour effet d’entraîner un double comptage.
No objections are raised should a Member State amend the preliminary total annual amounts of emission allowances allocated free of charge to installations in its territory included in the lists referred to in paragraph 1 and listed in point C of Annex I to this Decision before determining the final total annual amount for each year from 2013 to 2020 in accordance with Article 10(9) of Decision 2011/278/EU to the extent that the amendment consists of bringing the allocation in line with Article 10(2)(a) of Decision 2011/278/EU and excluding any allocation for processes that are covered by the system boundaries of the product benchmark for hot metal as defined in Annex I to Decision 2011/278/EU to an installation not producing, but importing hot metal that would otherwise lead to double counting.

promote and, in accordance with the implementation schedule of its action plan, require the use of best available techniques for new sources within source categories which a Party has identified as warranting such action in its action plan, with a particular initial focus on source categories identified in Part II of Annex C. In any case, the requirement to use best available techniques for new sources in the categories listed in Part II of that Annex shall be phased in as soon as practicable but no later than four years after the entry into force of the Convention for that Party.

If a Member State wishes to use its own official measurement method, that method shall be adapted in accordance with the definitions of the indicators set out in Annex I and in accordance with the principles governing long-term average measurements stated in ISO 1996-2: 1987 and ISO 1996-1: 1982.
