In order to determine duration of exclusion and to ensure compliance with the principle of proportionality, the institution responsible shall take into account in particular the seriousness of the facts, including their impacts on the Union’s financial interests and image and the time which has elapsed, the duration and recurrence of the offence, the intention or degree of negligence of the entity concerned and the measures taken by the entity concerned to remedy the situation.

Aux fins du présent article, on entend par «institution compétente» l’institution qui prend en charge les frais de soins programmés. Dans les cas visés à l’article 20, paragraphe 4, et à l’article 27, paragraphe 5, du règlement de base, dans lesquels les prestations en nature servies dans l’État membre de résidence sont remboursées sur la base de montants fixes, l’institution compétente désigne l’institution du lieu de résidence.
For the purposes of this Article, the competent institution shall mean the institution which bears the cost of the scheduled treatment; in the cases referred to in Article 20(4) and 27(5) of the basic Regulation, in which the benefits in kind provided in the Member State of residence are reimbursed on the basis of fixed amounts, the competent institution shall mean the institution of the place of residence.

For the calculation of the theoretical amount referred to in Article 46(2)(a) of the Regulation, in pension schemes for liberal professions, the competent institution shall take as the basis, in respect of each of the years of insurance completed under the legislation of any other Member State, the average annual pension entitlement acquired during the period of membership of the competent institution through the payment of contributions.

For the calculation of the theoretical amount referred to in Article 46(2)(a) of the Regulation, in basic or supplementary schemes in which old-age pensions are calculated on the basis of retirement points, the competent institution shall take into account, in respect of each of the years of insurance completed under the legislation of any other Member State, the number of retirement points arrived at by dividing the number of retirement points acquired under the legislation it applies by the number of years corresponding to these points".

Si la législation applicable conformément aux dispositions du paragraphe 2 ou du paragraphe 3 prévoit que le montant des prestations est établi compte tenu de l'existence de membres de la famille autres que les enfants, l'institution compétente prend également en considération les membres de la famille de l'intéressé qui résident sur le territoire d'un autre État membre, comme s'ils résidaient sur le territoire de l'État compétent.
4. If the legislation applicable under paragraph 2 or 3 provides that the amount of the benefits shall be determined taking into account the existence of members of the family other than the children, the competent institution shall also take into consideration the members of the family of the person concerned who are residing in the territory of another Member State, as if they were residing in the territory of the competent State.
