On 4 March 2010, the European Court of Justice found that Italy was in breach of EU legislation for having failed to set up in Campania a network of installations which is sufficient to ensure the disposal of urban waste in a manner which does not endanger human health and the environment (judgment in case C-297/08).

On 4 March 2010, the European Court of Justice found that Italy was in breach of EU legislation for having failed to set up a network of installations in Campania to ensure the disposal of urban waste in a manner which does not endanger human health and the environment (judgment in case C-297/08).

1. Conformément à l'article 8, paragraphe 2, de l'annexe I du statut, lorsque le Tribunal constate que le recours dont il est saisi, relève de la compétence de la Cour de justice ou du Tribunal de l'Union européenne, il le renvoie à la Cour de justice ou au Tribunal de l'Union européenne.
1. In accordance with Article 8(2) of Annex I to the Statute, where the Tribunal finds that the action before it falls within the jurisdiction of the Court of Justice or of the General Court, it shall refer that action to the Court of Justice or to the General Court.

La Cour de justice a également constaté que certains aspects de ces accords bilatéraux violaient la législation communautaire, notamment en relation avec la liberté d'établissement, empêchant les transporteurs de la Communauté de s'établir dans d'autres États membres et d'y exploiter des services au titre d'accords bilatéraux de cet État membre, créant ainsi une discrimination entre les transporteurs de la Communauté sur la base de la nationalité.
The Court of Justice also ruled that certain aspects of such bilateral agreements were infringing Community law notably in relation to the freedom of establishment prohibiting Community carriers to establish themselves in other Member States and provide services under bilateral agreements of that Member State thereby discriminating among Community carriers on the basis of nationality.

It has to be pointed out, nonetheless, that the EU has not yet succeeded in drawing up a support model that would be compatible with the multifunctional approach.

Les principaux domaines dans lesquels un manquement à la législation a été constaté, qu'il s'agisse d'une non-transposition dans le droit national ou d'un non-respect des dispositions du droit communautaire, sont: les déchets (trois États membres ont été condamnés par la Cour de justice en 2002 pour ne pas avoir établi de plans de gestion des déchets en conformité avec la législation sur les déchets), la pollution de l'eau par les nitrates d'origine agricole (plusieurs condamnations par la Cour de Justice), le traitement des eaux urbaines résiduaires, la qualité de l'eau et enfin, le respect des dispositions de la procédure d'évaluation des incidences sur l'environnement de certains projets publics ou privés.
The main fields in which there have been failures to comply with the legislation either because it has not been transposed into national law or because the provisions of the Community legislation were not being complied with are the following: solid waste (three Member States were found by the Court of Justice in 2002 not to have introduced plans for waste management in accordance with the legislation on solid waste), water pollution by nitrates from agriculture (several adverse judgements from the Court of Justice), the treatment of urban waste water, water quality and, finally, compliance with the procedure for environmental impact assessments for various public and private projects.
