Alors que jusqu’en 2012, l’allocation de quotas à titre gratuit était organisée à l’échelon national, à compter de 2013, le législateur a volontairement établi des règles totalement harmonisées pour l’allocation gratuite de quotas aux installations pour faire en sorte que toutes les installations soient traitées de la même manière.
Whereas until 2012, free allocation of emission allowances was organised nationally, for the period as of 2013 the legislator intentionally established fully-harmonised rules for free allocation to installations, so that all installations are treated in the same manner.

Tout exploitant d’une installation fixe ayant reçu une allocation à titre gratuit pour la période 2008-2012 et qui exerce des activités qui ne sont pas énumérées à l’annexe I de la directive 2003/87/CE, telle que modifiée par le règlement (CE) no 219/2009 du Parlement européen et du Conseil , mais qui figurent à l’annexe I de la directive 2003/87/CE, telle que modifiée par la directive 2009/29/CE du Parlement européen et du Conseil , est en droit d’utiliser des crédits internationaux au cours de la période 2008-2020 jusqu’à concurrence de la quantité à laquelle il pouvait prétendre pour la période 2008-2012, ou d’une quantité correspondant à 11 % au maximum de son allocation pour la période 2008-2012, ou jusqu’à concurrence de 4,5 % de ses émissions vérifiées pendant la période 2013-2020, la quantité la plus élevée étant retenue.
4. Each operator of a stationary installation which received a free allocation for the period from 2008 to 2012 and carrying out activities not listed in Annex I of Directive 2003/87/EC as amended by Regulation (EC) No 219/2009 of the European Parliament and of the Council , but listed in Annex I of Directive 2003/87/EC as amended by Directive 2009/29/EC of the European Parliament and of the Council shall be entitled to use international credits during the period from 2008 to 2020 up to the amount allowed to them from the period from 2008 to 2012, or to an amount corresponding to a maximum of 11 % of their allocation during the period from 2008 to 2012, or up to a maximum of 4,5 % of their verified emissions during the period from 2013 to 2020, whichever is the higher.

Each operator of a stationary installation with a significant capacity extension pursuant to Article 20 of Decision 2011/278/EU shall be entitled to use international credits during the period from 2008 to 2020 up to the amount allowed to it in the period from 2008 to 2012, or to an amount corresponding to a maximum of 11 % of their allocation during the period from 2008 to 2012, or up to a maximum of 4,5 % of their verified emissions during the period from 2013 to 2020, whichever is the higher.

Tout exploitant d’une installation fixe qui n’a reçu ni allocation à titre gratuit, ni autorisation d’utiliser des crédits internationaux au cours de la période 2008-2012 et, par dérogation au paragraphe 1, tout exploitant d’une installation fixe au sens de l’article 3, point h), premier et deuxième tirets, de la directive 2003/87/CE, est en droit d’utiliser des crédits internationaux au cours de la période 2008-2020, jusqu’à concurrence de 4,5 % de ses émissions vérifiées pour la période 2013-2020.

Each operator of a stationary installation which received neither a free allocation nor an entitlement to use international credits in the period from 2008 to 2012 and, by derogation from paragraph 1, each operator of a stationary installation within the meaning of the first two indents of Article 3(h) of Directive 2003/87/EC shall be entitled to use international credits in the period from 2008 to 2020 up to a maximum of 4,5 % of its verified emissions in the period from 2013 to 2020.
