Ordre public international : // Après avoir déterminé la loi applicable* à une situation juridique donnée conformément à ses règles de conflit de lois*, il arrive que le juge considère que l'application concrète de cette loi entraîne un résultat peu compatible avec le système de valeurs du for. En conséquence, il écarte la loi étrangère normalement applicable et applique sa propre loi. Traditionnellement chaque Etat membre dispose de son propre corps de règles d'ordre public international, mais avec la multiplication des dispositions impératives* d'origine communautaire on assiste aujourd'hui à la naissance d'un "ordre public européen".

La Commission note que, depuis que l’OTE a été introduit en bourse, les autorités grecques n’ont jamais prétendu que les obligations supportées par l’OTE en vertu de la législation du travail ne devaient pas être incluses dans le budget de la société, ni que l’État devait indemniser l’OTE pour les coûts supplémentaires découlant du statut permanent et des salaires élevés imposés par la loi.
Although, as pointed out in recital 93, the labour rules imposed on OTE are indeed an exception to the ordinary labour law applied to date to any other private company in Greece, and the permanent status and the high salaries guaranteed to OTE employees were not in reality the result of a freely negotiated collective agreement, but rather imposed on the company by the State itself, the Commission notes that at no time since OTE became a listed company did the Greek authorities indicate that OTE’s labour law liabilities did not have to be assumed by the company’s normal budget or that the State would have to compensate OTE for the extra costs of permanency and high salaries imposed by law on it. Likewise, OTE’s stock valuation was also based on the assumption that the permanency and high salary costs of OTE are normally for OTE’s budget to bear.

Il est plus facile d'invectiver et de polémiquer que de légiférer, et je crois que le délai au bout duquel on propose aujourd'hui six textes, c'est-à-dire six contributions très importantes à la mise en œuvre d'une base juridique de sécurité maritime européenne qui n'existait pas, est un délai normal, et je crois qu'il faut que le Parlement et la Commission se félicitent du travail qu'ils ont accompli : la Commission, pour nous avoir proposé six textes ; le Parlement, pour les avoir, grâce à ses rapporteurs, examinés dans des délais records.
It is easier to hurl abuse and to argue than to legislate, and I believe that the length of time waited, at the end of which six texts have been proposed, and these are six extremely important contributions to implement a legal basis for maritime safety in Europe, which did not previously exist, is normal. I also believe that Parliament and the Commission must be congratulated for the work that they have done – the Commission for having proposed six texts and Parliament for having examined them, thanks to the rapporteurs, in record time.
