Taking account of the right of a democratically elected parliament to adopt law in line with fundamental rights, with respect for political minorities, and with a democratically adequate and transparent procedure, and of the duty courts, both ordinary and constitutional, to safeguard the compatibility of the laws with the constitution, underlines the importance of the principle of separation of powers and a properly functioning system of checks and balances; is concerned in this connection about the shift of powers in constitutional matters to the advantage of the parliament and to the detriment of the Constitutional Court, which undermines severely the principle of separation of powers and a properly functioning system of checks and balances, which are key corollaries of the rule of law; welcomes in this regard the Eger joint statement of 16 May 2013 by the Presidents of the Hungarian and Romanian Constitutional Courts, Péter Paczolay and Augustin Zegrean, stressing that constitutional courts bear a special responsibility in countries ruled by a two-thirds majority;

E. considérant que le vice-ministre de la justice de la République d'Azerbaïdjan, Vilayat Zahirov, a adressé le 15 août 2012 une lettre officielle au ministère de l'administration publique et de la justice de Hongrie, dans laquelle il faisait observer qu'il avait été procédé, en conformité avec l'article 9, paragraphe 1 a), de la convention et sans convertir les condamnations, à l'exécution des décisions, prises par des juridictions étrangères, concernant le transfert de personnes condamnées, afin que ces dernières puissent purger le restant de leur peine d'emprisonnement en République d'Azerbaïdjan; qu'il a par ailleurs donné l'assurance que, conformément au code pénal de la République d'Azerbaïdjan, la sanction visant un condamné purgeant une peine de prison à vie ne pouvait être remplacée que par une peine d'emprisonnement d'une durée déterminée fixée par une juridiction, et que le condamné ne pouvait bénéficier d'une liberté conditionnelle qu'après avoir au moins purgé 25 ans de sa peine; que les autorités azerbaïdjanaises ont donc refusé de donner toute assurance diplomatique à leurs homologues hongroises;
E. whereas the Deputy Minister of Justice of the Republic of Azerbaijan, Vilayat Zahirov, sent an official letter to the Ministry of Public Administration and Justice of Hungary on 15 August 2012, in which he stated that the execution of the decisions of foreign states’ courts regarding the transfer of sentenced persons to serve the remaining part of their prison sentences in the Republic of Azerbaijan were carried out in accordance with Article 9(1)(a) of the convention, without any conversion of their sentences; whereas he further gave an assurance that, according to the Criminal Code of the Republic of Azerbaijan, the punishment of a convict serving a life sentence could only be replaced by a court with a term of imprisonment for a specified period, and that the convict could be released on conditional parole only after serving at least 25 years of his or her prison sentence; and whereas the Azerbaijani authorities subsequently denied having given any diplomatic assurances to the Hungarian authorities;

4. invite les autorités hongroises à rétablir l'indépendance de la gouvernance des médias par l'intermédiaire d'une représentation politique paritaire et de la participation d'associations de journalistes, tout en limitant exclusivement à l'audiovisuel la gouvernance des médias et en levant le contrôle qu'elles exercent sur la presse et l'internet; les invite également à rétablir les garde-fous constitutionnels relatifs au pluralisme des médias et un véritable contrôle judiciaire par l'intermédiaire d'un droit de recours auprès de juridictions ordinaires, à limiter exclusivement à la télévision les interférences étatiques qui affectent la liberté d'expression, en lien avec une couverture équilibrée, à protéger le journalisme d'investigation en respectant la confidentialité des sources et en levant toute obligation en matière de contenu des informations, à abolir l'enregistrement en tant que condition préalable à toute activité et à respecter le principe du pays d'origine inscrit dans la directive "services de médias audiovisuels";
4. Calls on the Hungarian authorities to restore independence of media governance, with a parity based political composure and participation of journalists associations, while restricting media governance to the audiovisual field, removing its control over press and the internet; restore constitutional safeguards for media pluralism and true judicial overview by appeals to ordinary courts; limit the state interference with freedom of expression concerning balanced coverage to television only; protect investigative journalism by protection of confidential sources, removing news prescriptions and registration as a pre-requisite for operation; respect the country of origin principle enshrined in the AVMSD;
