TRADUCTIONS EN CONTEXTE

Dans ce contexte, la juridiction bulgare a saisi la Cour de justice pour lui poser tout d’abord deux questions d’ordre procédural, à savoir si, lorsqu’elle réexamine la situation de l’intéressé à l’issue du délai initial de rétention, l’autorité administrative compétente doit adopter un acte écrit motivé en droit et en fait et si le contrôle de légalité d’un tel acte nécessite que l’autorité judiciaire compétente puisse statuer sur le fond de l’affaire.
Against that background the Bulgarian court has referred a number of questions to the Court of Justice for a preliminary ruling. The first two questions concern procedural matters, namely (i) whether, when it re-examines the situation of the person concerned at the end of an initial period of detention, the competent administrative authority must adopt a measure in writing with reasons being given in fact and in law and (ii) whether the review of the legality of such a measure requires that the court having jurisdiction be able to give a decision on the merits of the case.

Along this line, having an external analysis of the way the prosecution and courts operates can support the Bulgarian reform effort.

À l’issue du délai initial de rétention, les autorités bulgares ont saisi une juridiction administrative bulgare afin d’obtenir la prolongation de la rétention, invoquant notamment le risque de fuite et le manque de coopération de l’intéressé.
Following an initial period of detention, the Bulgarian authorities brought proceedings before a Bulgarian administrative court seeking to have the detention extended: they relied, in particular, on the risk of Mr Mahdi absconding and on a lack of cooperation on his part.

La Cour déclare donc qu’à supposer que les autorités bulgares aient, avant de saisir la juridiction administrative, statué sur la suite à réserver à la rétention, un acte écrit motivé en droit et en fait était nécessaire.
Thus, if the Bulgarian authorities, before bringing the matter before the administrative court, had taken a decision on the continuation of the detention, there had to be a measure in writing with reasons being given in fact and in law.

En revanche, dans l’hypothèse où les autorités bulgares auraient uniquement réexaminé la situation de M. Mahdi sans statuer sur la demande de prolongation (ce qu’il appartient à la juridiction de renvoi de vérifier), elles n’étaient pas tenues d’adopter un acte exprès faute de dispositions en ce sens dans la directive.
If, however, the Bulgarian authorities simply re-examined Mr Mahdi’s situation without deciding on the application to extend the detention (a matter which it is for the referring court to determine), they were not obliged to adopt an express measure since the Directive makes no provision to that effect.

[75] Case C-394/11 Belov, the first Roma-specific discrimination case referred to the Court of Justice was declared ‘not admissible’ by the Court on 31 January 2013, since the Bulgarian Equality Body (which referred the case to the Court) was not considered to be a court or tribunal within the meaning of the Treaty.
