Comme la procédure concernant la validité d’un brevet doit être engagée devant les juridictions de l’État membre dans lequel le brevet a été enregistré, la juridiction saisie de l'action en contrefaçon est contrainte de surseoir à statuer dans l’attente de l’issue de l’action relative à la validité du brevet.
Since proceedings concerning the validity of patents must be brought before the courts of the Member State in which the patent has been registered, the infringement court is obliged to stay proceedings pending the outcome of the proceedings concerning the validity.

In that context, the national court essentially asks the Court of Justice whether a patent obtained following an application claiming the invention both of the process of manufacture of a pharmaceutical product and of the pharmaceutical product as such, but, because of that reservation, granted only for the process of manufacture, must none the less, by reason of the TRIPs Agreement and from the date of its entry into force, be regarded as also covering the invention of the pharmaceutical product.

Is of the opinion that a Unified Patent Court can be created by means of an international agreement; stresses, however, that the Unified Patent Court must respect Union law; believes that this respect for the primacy and proper application of Union law should be ensured inter alia by providing for the possibility of requesting preliminary rulings from the Court of Justice of the European Union in accordance with Article 267 of the TFEU; believes, furthermore, that it is necessary to ensure that any decision of the Unified Patent Court which infringes European Union law may give rise to some form of financial liability on the part of one or more Member States;
