S. considérant que le Conseil a nommé M Rosalind Marsden en tant que représentante spéciale de l'Union européenne (RSUE) pour le Soudan en août 2010 et a ensuite élargi et prolongé son mandat mais a accepté uniquement une prolongation de quatre mois en juin 2013 jusqu'au 31 octobre 2013 afin d'intégrer son mandat avec celui du RSUE pour la Corne de l'Afrique, en dépit de son travail exceptionnel et de son rôle important pour tirer parti des différents instruments de l'UE et de son influence sur les développements dans la région; considérant qu'en l'absence de représentant spécial de l'Union désigné pour le Soudan/Soudan du Sud, l'Union européenne sera reléguée à un rôle secondaire dans le cadre des négociations et des actions internationales;
S. whereas the Council appointed Ms Rosalind Marsden as the European Union Special Representative (EUSR) for Sudan in August 2010 and subsequently enlarged and extended her mandate, but in June 2013 only agreed to a four-month extension until 31 October 2013 in order to integrate it into the mandate of the EUSR for the Horn of Africa, despite her outstanding work and her important role in leveraging the EU’s various tools and influence on the developments in the region; whereas without a designated EU Special Representative for Sudan/South Sudan, the EU will be side-lined in international negotiations and efforts;

Au sujet de l'avocat du cabinet auquel le plaignant 3 a fait référence dans sa plainte, l'Allemagne a expliqué ce qui suit: a) cet avocat a travaillé pour le Land de Rhénanie-Palatinat de mai 2012 jusqu'en avril 2013, soit avant le lancement de la procédure d'appel d'offres, en juin 2013; b) cet avocat n'a entretenu de contacts ni avec le Land de Rhénanie-Palatinat, ni avec la République fédérale d'Allemagne pendant la procédure d'appel d'offres; c) cet avocat n'a jamais conseillé le Land de Rhénanie-Palatinat ou les vendeurs à propos de la procédure d'appel d'offres; et d) cet avocat a seulement participé en qualité d'expert indépendant à l'audition du Landtag de Rhénanie-Palatinat du 20 juin 2013 sur la loi relative à l'accès public au circuit du Nürburgring.
Regarding the particular lawyer of that law firm, to which complainant 3 has referred in its complaint, Germany has also explained the following: (a) that lawyer worked for the Land from May 2012 until April 2013, i.e. before the initiation of the tender process in June 2013; (b) that lawyer was not in any contact with the Land or the Federal Republic of Germany during the tender process; (c) that lawyer never advised the Land or the sellers in relation to the bidding process; and (d) the same lawyer only participated as an independent expert in the hearing of the Land's parliament on 20 June 2013 concerning the law for the public access to the Nürburgring racetrack.

G. considérant qu'une requête a été déposée, le 11 juin 2013, auprès du parquet polonais afin qu'une troisième personne, le Yéménite Walid Mohammed Bin Attash, soit reconnue officiellement comme victime, étant donné qu'il a été arrêté illégalement au Pakistan en 2003 et incarcéré dans une prison secrète en Pologne de juin à septembre 2003, et qu'il est aujourd'hui détenu à Guantánamo; considérant que le parquet polonais a prolongé jusqu'en octobre 2013 son enquête criminelle ouverte il y a cinq ans;
G. whereas a request was filed with the Polish prosecutors on 11 June 2013 for a third man, the Yemeni Walid Mohammed Bin Attash, to be officially recognised as a victim, having been illegally arrested in Pakistan in 2003 and kept in a secret prison in Poland from June to September 2003 and now being held in Guantánamo; whereas the Polish prosecutors have extended their five-year-old criminal investigation up to October 2013;

On 25 June 2012, the Council adopted Decision 2012/329/CFSP (2) extending the mandate of the EUSR for the Horn of Africa until 30 June 2013.
