– (EN) Monsieur le Président, la position que le Parlement européen va adopter aujourd’hui en votant sur la proposition de directive de la Commission relative à la coopération administrative dans le domaine fiscal est sans préjudice de la position finale qui sera adoptée par le Parlement au sujet de l’application de l’article 291 du traité sur le fonctionnement de l’Union européenne et des conséquences sur les procédures basées sur la décision 1999/468/CE du Conseil du 28 juin 1999, particulièrement en ce qui concerne la procédure de réglementation avec contrôle ou la position que le Parlement pourrait vouloir adopter au sujet d’actes délégués dans d’autres législations.
– Mr President, the opinion that the European Parliament will vote now on the Commission’s proposal for a directive on administrative cooperation in the field of taxation does not prejudice the final position that the Parliament will take with regard to the implementation of Article 291 of the Treaty on the Functioning of the European Union and the consequences for the procedures based on Council Decision 1999/468/EC of 28 June 1999, especially as regards the regulatory procedure with scrutiny or the position that the Parliament may wish to take on delegated acts in other legislation.

The violation of specific conditions such as those relating to unassessed areas, the operation of the Vessel Monitoring System and the relocation of activities in case of unforeseen encounter with a vulnerable marine ecosystem may result in irreparable damage to such ecosystems and deserves therefore to be included among the list of serious infringements contained in Council Regulation (EC) No 1447/1999 of 24 June 1999 establishing a list of types of behaviour which seriously infringe the rules of the common fisheries policy (6).

Building on the experience and strengths of the URBAN Community initiative provided for in Article 20(1)(b) of Council Regulation (EC) No 1260/1999 of 21 June 1999 laying down general provisions on the Structural Funds (5), sustainable urban development should be reinforced by fully integrating measures in that field into the operational programmes co-financed by the ERDF, paying particular attention to local development and employment initiatives and their potential for innovation.

Having regard to the Treaties and in particular the provisions guaranteeing unhindered access to the single European market, bearing in mind the British Government’s formal announcement, in a statement to Parliament on 8 November 2000, that it will introduce a tax on all ‘foreign’ road hauliers using British roads by means of a toll which all non-British hauliers will have to pay, given that a discriminatory toll on non-British road hauliers would severely damage the internal market and be particularly damaging for the economy of Ireland because 70 per cent of Irish exports in the rest of the EU and further afield use the British landbridge and having regard to Directive 1999/62/EC of 17 June 1999 on charges for use of certain infrastructures, would the Commission please outline what action it will take to maintain the freedoms of the internal market and ensure compliance with Directive 1999/62/EC by the British Government?
