TRADUCTIONS EN CONTEXTE

Le demandeur fait notamment référence à des points de l’arrêt Kyrian qui indiquent que l’objectif visé par la directive 76/308/CEE, à savoir l’accomplissement effectif des notifications de tous actes et décisions, ne peut être atteint sans respecter les intérêts légitimes des destinataires des notifications ; que l’une des fonctions de la notification est de permettre au destinataire de faire valoir ses droits ; que tant l’objet de la demande que la cause de l’action devaient être identifiés de façon certaine (ce qui incluait, dans l’arrêt Kyrian, la notification dans la langue officielle de l’État membre où l’autorité requise avait son siège) et que, étant donné que la directive 76/308/CEE ne prévoyait pas de conséquences en cas de non-respect de cette exigence, « il appartient au juge national d’appliquer son droit national tout en veillant à assurer la pleine efficacité du droit communautaire, ce qui peut le conduire à interpréter une règle nationale qui a été élaborée en ayant uniquement en vue une situation purement interne afin de l’appliquer à la situation transfrontalière en cause » .
The plaintiff refers, inter alia, to paragraphs in Kyrian in which it is held that the purpose of effective notification of all instruments and decisions that is inherent in Directive 76/308 cannot be attained unless it respects the legitimate interests of the addressees of notifications; that one of the functions of notification is to allow the addressee to assert his rights; that both the subject matter of the claim and the cause of action had to be identified with a degree of certainty (which entailed in Kyrian notification in the official language of the Member State in which the requested authority was situated) and that given that Directive 76/308 did not set out the consequences of failing to comply with this requirement ‘it is for the national court to apply national law while taking care to ensure the full effectiveness of Community law, a task which may lead it to interpret a national rule which has been drawn up with only a purely domestic situation in mind in order to apply it to the cross-border situation at issue’

La Cour a considéré que, en l’absence de dispositions dans la directive 76/308/CEE, relatives aux conséquences découlant de ce que la notification a été effectuée dans une langue autre qu’une langue officielle de l’État membre où l’autorité requise a son siège, « il appartient au juge national d’appliquer son droit national tout en veillant à assurer la pleine efficacité du droit communautaire, ce qui peut le conduire à interpréter une règle nationale qui a été élaborée en ayant uniquement en vue une situation purement interne afin de l’appliquer à la situation transfrontalière en cause » .
The Court took the view that in the absence of provisions in Directive 76/308 on the consequences flowing when notification is made in a language other than the language of the requested Member State, ‘it is for the national court to apply national law while taking care to ensure the full effectiveness of Community law, a task which may lead it to interpret a national rule which has been drawn up with only a purely domestic situation in mind in order to apply it to the cross border situation at issue’ This was held to be subject only to the principles of equivalence and effectiveness

La Cour de justice a également jugé que le défaut de notification d'une règle technique peut être invoqué dans un litige entre particuliers; il incombe alors au juge national de refuser d'appliquer cette disposition et d'en déterminer les conséquences sur le contrat porté devant lui en fonction du droit national.
The Court of Justice has also ruled that failure to notify a technical regulation can be invoked in a dispute between individuals; it is then for the national judge to refuse to apply this provision and to establish the consequences for the contract brought before him in the light of national law.

- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. On ne sait pas non plus si après la prescription on peut encore compenser ou accepter un paiement spontané du débiteur. Bref, la proposition introduit de la sécurité pour les institutions et pour les débiteurs.
- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.

D’application pratique difficile (méconnaissance totale par le consommateur du droit étranger, difficulté pour le juge national d’appliquer un droit étranger contradictoire avec le droit national, etc.), le principe de reconnaissance mutuelle risque de conduire à une dérégulation nuisible tant aux opérateurs économiques qu’aux consommateurs. En effet, les opérateurs soumis au droit des États disposant d’une législation plus protectrice des consommateurs seront nécessairement victimes de discriminations par rapport aux opérateurs étrangers soumis à des dispositions moins contraignantes et seront donc tentés d’exercer des pressions sur leurs gouvernements pour obtenir l’alignement de leur législation nationale sur les législations les plus libérales.
The original provision is difficult to apply in practice (consumers know nothing whatsoever about foreign law, it is difficult for a national judge to apply foreign law which conflicts with national law, etc), the principle of mutual recognition could well lead to deregulation that is harmful both to economic operators and consumers because operators who are subject to the law of Member States with legislation providing greater consumer protection will necessarily be discriminated against compared with foreign operators who are subject to less stringent provisions and will therefore be tempted to pressurise their governments to bring their national legislation into line with more liberal legislation.

Le consommateur méconnaît totalement le droit étranger, tout comme le juge national a des difficultés lorsqu'il s'agit d'appliquer des règles de droit d'un pays autre que le sien.
