I would also draw attention to another aspect of the controversy surrounding the compensation and status of provincially appointed judges that is not referred to in Chief Justice Lamer's judgment, and that is the extreme unhappiness of many provincial court judges, especially those sitting in provincial criminal courts, about the wide disparity between their salaries and pension entitlements and those of federally appointed judges despite the fact that 90 per cent or more of all cases under the federal Criminal Code are tried in the provincial courts.
