– Bien qu’assez technique, le rapport que nous avons adopté hier, en session plénière du Parlement Européen, est très important, dans la construction toujours plus poussée d’un espace européen de liberté, sécurité et justice, d’un espace judiciaire européen et donc dans la consolidation du marché intérieur européen.
– (FR) The report that we adopted yesterday, in the European Parliament sitting, despite being quite technical, is very important in the ever-greater integration of a European area of freedom, security and justice, of a European judicial area, and therefore in the consolidation of the European internal market.

Du fait de cette évolution, le Réseau judiciaire européen est encore plus nécessaire qu’au moment de sa création et il devrait donc être renforcé.
Because of this evolution, the European Judicial Network is even more necessary than at the time of its creation and should therefore be strengthened.

Au cours de sa réunion du 17 novembre 2008, la commission des affaires juridiques a donc décidé, à l'unanimité, de vous recommander de faire référence à l'article 61, points c) et d), à l'article 66 et à l'article 67, paragraphe 5, second tiret, du traité CE pour établir la base juridique de la proposition de décision du Parlement européen et du Conseil modifiant la décision 2001/470/CE du Conseil relative à la création d'un réseau judiciaire européen en matière civile et commerciale.
At its meeting of 17 November 2008 the Committee on Legal Affairs accordingly decided, unanimously, to recommend to you that the proposal for a Decision of the European Parliament and the Council amending Council Decision 2001/470/EC establishing a European Judicial Network in civil and commercial matters should be based on Article 61(c) and (d) and Article 66 and the second indent of Article 67(5) of the EC Treaty.

Parliament therefore supports the Commission Communication (COM(2002) 247 final - A Project for the European Union). Under section 1.2 of that document (entitled The Union must build up an EU-wide area of freedom, security and justice) it is stated that ‘the Union also needs to take steps to build up a genuine European area of justice, based on civil and criminal judicial cooperation which would in the future be within a single institutional and legal framework.

Le Conseil européen approuve donc le principe de reconnaissance mutuelle, qui, selon lui, devrait devenir la pierre angulaire de la coopération judiciaire en matière tant civile que pénale au sein de l'Union.
The European Council therefore endorses the principle of mutual recognition which, in its view, should become the cornerstone of judicial cooperation in both civil and criminal matters within the European Union.
