The effect of the amended version of the second and third sentences of Section 20(1)(3) of the ITA in conjunction with Article XXIII(5) of the Structural Adjustment Act (Federal Gazette 297/1995) was to make only half the cost of business entertainment deductible. Regardless of proof that entertainment costs primarily serve business purposes, the Austrian Ministry of Finance is of the opinion that, for turnover tax purposes, this must be assessed as 50% non-business consumption, pursuant to Section 1(1)(2)(c) of the TTA, ultimately making only half of the cost of entertainment input-tax-deductible.
