(10) As regards the legal basis of the tax credit in force from 1 January to 31 December 1998, the eleventh additional provision of Provincial Law No 33/1997 of 19 December 1997 reads as follows: "1. For 1998 only, investments initiated as from 1 January 1998 which exceed ESP 2500 million will be eligible for the tax credit of 45 % of the investment.

(11) En ce qui concerne le crédit d'impôt de 45 % en vigueur du 1er janvier 1999 au 31 décembre 1999, le libellé de la Onzième disposition additionnelle de la Loi provinciale n° 36/1998 du 17 décembre 1998 précitée est le suivant: "(1) Avec effets limités exclusivement à l'année 1999, les processus d'investissement initiés à partir du 1er janvier 1999, excédant 2500 millions d'ESP, bénéficieront d'un crédit d'impôt de 45 % du montant de l'investissement.

(12) En résumé, il ressort de ces dispositions que l'objet des aides est constitué, d'une part, par l'investissement en actifs fixes matériels neufs réalisés pendant la période du 1er janvier 1995 au 31 décembre 1997 et ensuite par le processus d'investissement pendant la période de 1er janvier 1998 au 31 décembre 1999 et, d'autre part, par les dépenses d'investissement(12) effectuées dans la phase de préparation du projet se trouvant à la base des investissements, pour autant qu'ils excèdent 2,5 milliards d'ESP et qu'ils soient initiés pendant la période du 1er janvier 1995 au 31 décembre 1999.
(12) In short, it is clear from the above provisions that the aid is granted in respect of, firstly, investments in new tangible fixed assets made during the period from 1 January 1995 to 31 December 1997, and then the investment process from 1 January 1998 to 31 December 1999, and secondly the investment expenditure incurred in the preparatory stage(12) of the project which generates the investments, provided that they exceed ESP 2500 million and were initiated between 1 January 1995 and 31 December 1999.
