(1) Council Directive 65/65/EEC of 26 January 1965 on the approximation of provisions laid down by law, regulation or administrative action relating to medicinal products(4) requires that applications for authorisation to place a medicinal product on the market should be accompanied by a dossier containing particulars and documents relating to the results of tests and clinical trials carried out on the product. Council Directive 75/318/EEC of 20 May 1975 on the approximation of the laws of Member States relating to analytical, pharmaco-toxicological and clinical standards and protocols in respect of the testing of medicinal products(5) lays down uniform rules on the compilation of dossiers including their presentation.

1. A toothpaste must be regarded as a cosmetic product within the meaning of Community law and is covered by Council Directive 76/768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products unless the average well-informed consumer may infer with certainty, from the statements on the packaging of the product, from advertising and generally from its presentation for sale, that it is a substance presented for treating or preventing disease within the meaning of Council Directive 65/65/EEC of 26 January 1965 on the approximation of provisions laid down by law, regulation or administrative action relating to proprietary medicinal products.

3. Pour autant que ces produits, bien que considérés en droit interne comme des denrées alimentaires, sont en substance identiques de par leur composition ou leurs effets pharmacologiques à des produits dont la mise sur le marché a été autorisée conformément à la procédure instituée par la directive 65/65/CEE du Conseil, du 26 janvier 1965, concernant le rapprochement des dispositions législatives, réglementaires et administratives, relatives aux médicaments, modifiée, les États membres ont le droit d'en interdire la fabrication et la commercialisation sur leur territoire, conformément aux conditions énoncées à l'article 36 du traité, sous la réserve qu'une directive ne peut pas avoir comme effet, par elle-même et indépendamment des législations nationales, que celles-ci aient ou non été adoptées pour son application, de déterminer ou d'aggraver la responsabilité pénale de ceux qui agissent en infraction à ses dispositions.
(3) In so far as such products, though treated under national law as foodstuffs, are materially identical in their composition or pharmacological effects to products whose marketing has been authorised in accordance with the procedure established by Council Directive 65/65/EEC of 26 January 1965 on the approximation of provisions laid down by law, regulation or administrative action relating to medicinal products, as amended, the Member States are entitled to prohibit their manufacture and marketing in their territory, in accordance with the conditions laid down in Article 36 of the Treaty, subject to the proviso that a directive cannot, of itself and independently of national laws, whether or not these have been adopted for its implementation, have the effect of determining or aggravating the liability in criminal law of persons who act in contravention of the provisions of that Directive.

This Directive covers the wholesale distribution in the Community of medicinal products for human use to which Chapters II to V of Council Directive 65/65/EEC of 26 January 1965 on the approximation of provisions laid down by law, regulation or administrative action relating to medicinal products(4) apply.
