Comme l'a indiqué le président de la commission ITRE dans sa lettre, le rapporteur, Ivo Belet souhaite modifier la base juridique de la proposition en la remplaçant par une référence au traité sur le fonctionnement de l'Union européenne (traité FUE), en particulier son article 168, paragraphe 4, point b), libellé comme suit:
