J. considérant cependant que, avec l'adhésion de l'Union à la CEDH, celle-ci sera peut-être amenée, avec le temps, à rechercher un critère commun pour les affaires transfrontières portant sur la liberté de fournir des biens et des services à la suite d'un «dialectical development», comme espéré par l'avocat général Mancini dans l'affaire Bond van Adverteerders , et compte tenu également des arrêts Elliniki Radiofonia Tileorasi et Society for the Protection of Unborn Children Ireland Ltd ainsi que des conclusions de l'avocat général Jacobs dans l'affaire Christos Konstantinidis ; considérant, en effet, que dans l'affaire Society for the Protection of Unborn Children Ireland Ltd , l'avocat général Van Gerven a proposé d'admettre «qu'une réglementation nationale qui, pour demeurer compatible avec le droit [de l'Union], doit se référer à des notions juridiques telles que les raisons impérieuses liées à l'intérêt général ou à l'ordre public (...) se situe »dans le cadre' du droit [de l'Union]' au motif que, bien que ces notions d'intérêt général et d'ordre public puissent être définies dans une large mesure par les États membres, leur portée dans le cas de mesures relevant du droit de l'Union reste néanmoins soumise au contrôle de l'Union et elles doivent être «justifiées et délimitées d'une manière uniforme pour l'ensemble de [l'Union] en fonction du droit [de l'Union], c'est-à-dire en tenant compte également des principes généraux relatifs aux droits et libertés fondamentaux»;
J. whereas, notwithstanding this, with the Union's accession to the ECHR, the Union may over time have to find a common yardstick in cross-border cases relating to the freedoms to supply goods and services as a result of the ‘dialectical development’ looked forward to by Advocate General Mancini in the Bond van Adverteerders case, having regard also to the judgments in Elliniki Radiofonia Tileorasi and Society for the Protection of Unborn Children Ireland Ltd and Advocate General Jacobs' opinion in Christos Konstantinidis ; indeed, in the case Society for the Protection of Unborn Children Ireland Ltd , Advocate General Van Gerven put forward the proposition that ‘a national rule which in order to show that it is compatible with [Union] law has to rely on legal concepts, such as imperative requirements of public interest or public policy .falls ’within the scope' of [Union] law' on the ground that, although the Member States have some discretion in defining the public interest or public policy concepts, the scope of those concepts in the case of measures falling within the scope of Union law is nevertheless subject to Union control and they have to be ‘justified and delimited in a uniform manner for the whole [Union] under [Union] law and therefore taking into account the general principles in regard to fundamental rights and freedoms’;

– (PT) Dans le cadre de la demande d’aide de l’Irlande pour 850 cas de licenciement chez SR Technics Ireland Ltd, active dans le secteur du transport aérien dans la région NUTS III de Dublin, j’ai voté pour la résolution parce que je suis d’accord avec la proposition de la Commission, ainsi qu’avec les amendements respectifs introduits par le Parlement.
– (PT) In the context of Ireland’s request for assistance for 850 redundancies at SR Technics Ireland Ltd, operating in the air transport sector in the NUTS III Dublin region, I voted in favour of the resolution as I agree with the Commission’s proposal, along with the respective amendments introduced by Parliament.
