If a transferor is aware that the items as defined by sentence 1 above, which he proposes to transfer and the final destination of which is outside the European Union, are intended for a purposes mentioned in sentence 1 above and the purchasing country or country of destination is Algeria, India, Iran, Iraq, Israel, Jordan, Libya, North Korea, Pakistan or Syria, he must notify the Federal Office of Economics and Export Control (BAFA); it will decide whether or not the transfer is subject to licensing.

7(4): The transfer of goods not specified in the Export Control List (Annex AL) shall require a licence if the final destination of the goods is outside the European Union and the transferor has been informed by the Federal Office of Economics and Export Control that the goods are or may be intended, in their entirety or in part, for the setting-up, operation, or incorporation into a plant for nuclear purposes as defined by Section 5d, paragraph 1 AWV, and if the purchasing country or country of destination is Algeria, India, Iran, Iraq, Israel, Jordan, Libya, North Korea, Pakistan or Syria.
