(52) In order to give all relevant information to investors, it is appropriate to require investment firms providing investment advice to clarify the basis of the advice they provide, in particular the range of products they consider in providing personal recommendations to clients, the cost of the advice or, where the cost of fees and inducements cannot be ascertained prior to the provision of the advice, the manner in which the cost will be calculated, whether the investment advice is provided in conjunction with the acceptance or receipt of third-party inducements and whether the investment firms provide the clients with the periodic assessment of the suitability of the financial instruments recommended to them.

Lorsqu'une mesure de financement des risques est mise en œuvre en passant par un intermédiaire financier qui cible des entreprises admissibles à différents stades de leur développement, mentionnés au paragraphe 10, et qu'elle ne prévoit pas de participation de capitaux privés au niveau des entreprises admissibles, l'intermédiaire financier veille à atteindre un taux de participation privée représentant au moins la moyenne pondérée calculée sur la base du volume des investissements individuels dans le portefeuille sous-jacent et résultant de l'application, à ces investissements, des taux de participation minimaux mentionnés au paragraphe 10.
11. Where a risk finance measure is implemented through a financial intermediary targeting eligible undertakings at different development stages as referred to in paragraph 10 and does not provide for private capital participation at the level of the eligible undertakings the financial intermediary shall achieve a private participation rate that represents at least the weighted average based on the volume of the individual investments in the underlying portfolio and resulting from the application of the minimum participation rates to such investments as referred to in paragraph 10.
