REFERRING to the provision that, pursuant to Article 68(3) of the Treaty establishing the European Community, the Council of the European Union, the European Commission and the Member States may request the Court of Justice of the European Communities to give a ruling on the interpretation of acts of the institutions of the Community based on Title IV of the Treaty, including the interpretation of this Agreement, and the circumstance that this provision shall not be binding upon or applicable in Denmark, according to the Protocol on the position of Denmark.

SE RÉFÉRANT à la compétence accordée à la Cour de justice des Communautés européennes, au titre de l’article 68, paragraphe 1, du traité instituant la Communauté européenne, pour statuer sur des questions préjudicielles relatives à la validité et à l’interprétation d’actes pris par les institutions de la Communauté sur la base du titre IV du traité, y compris sur la validité et l’interprétation du présent accord, et à la circonstance que cette disposition ne lie pas le Danemark et n’y est pas applicable, comme il résulte du protocole sur la position du Danemark,
REFERRING to the jurisdiction conferred to the Court of Justice of the European Communities pursuant to Article 68(1) of the Treaty establishing the European Community to give rulings on preliminary questions relating to the validity and interpretation of acts of the institutions of the Community based on Title IV of the Treaty, including the validity and interpretation of this Agreement, and to the circumstance that this provision shall not be binding upon or applicable in Denmark, as results from the Protocol on the position of Denmark.

2. Lorsque le tribunal de première instance ou la cour d'appel a décidé de saisir la Cour de justice de l'Union européenne d'une question portant sur l'interprétation du traité sur l'Union européenne ou du traité sur le fonctionnement de l'Union européenne, ou d'une question concernant la validité ou l'interprétation des actes adoptés par les institutions de l'Union européenne, il ou elle suspend la procédure.
2. Whenever the Court of First Instance or the Court of Appeal has decided to refer to the Court of Justice of the European Union a question of interpretation of the Treaty on European Union or of the Treaty on the Functioning of the European Union or a question on the validity or interpretation of acts of the institutions of the European Union, it shall stay its proceedings.

May the Treaty on the Functioning of the European Union be interpreted as meaning that, in the case of the service described in the first question, the country of destination, to which the service is sent, is entitled to limit the supply of that type of services by requiring that the [supplier of the] service has to be registered in that Member State and has to be established as a branch or independent legal entity, and allowing this type of services to be supplied only through the establishment of a branch or independent legal entity?

Peut-on interpréter le traité sur le fonctionnement de l’Union européenne en ce sens que le principe de libre prestation des services entre États membres s’étend au service mentionné à la question 1) dans la mesure où il s’agit d’un service fourni depuis le Luxembourg sur le territoire de la Hongrie?

(15) The Diplomatic Conference held under the auspices of the World Intellectual Property Organisation (WIPO) in December 1996 led to the adoption of two new Treaties, the "WIPO Copyright Treaty" and the "WIPO Performances and Phonograms Treaty", dealing respectively with the protection of authors and the protection of performers and phonogram producers.
