IN-CONTEXT TRANSLATIONS

In cooperation with the Member States, the Commission and the High Representative will: · Work towards a coherent EU International cyberspace policy to increase engagement with key international partners and organisations, to mainstream cyber issues into CFSP, and to improve coordination of global cyber issues; · Support the development of norms of behaviour and confidence building measures in cybersecurity. Facilitate dialogues on how to apply existing international law in cyberspace and promote the Budapest Convention to address cybercrime; · Support the promotion and protection of fundamental rights, including access to information and freedom of expression, focusing on: a) developing new public guidelines on freedom of expression online and offline; b) monitoring the export of products or services that might be used for censorship or mass surveillance online; c) developing measures and tools to expand Internet access, openness and resilience to address censorship or mass surveillance by communication technology; d) empowering stakeholders to use communication technology to promote fundamental rights; · Engage with international partners and organisations, the private sector and civil society to support global capacity-building in third countries to improve access to information and to an open Internet, to prevent and counter cyber threats, including accidental events, cybercrime and cyber terrorism, and to develop donor coordination for steering capacity-building efforts; · Utilise different EU aid instruments for cybersecurity capacity building, including assisting the training of law enforcement, judicial and technical personnel to address cyber threats; as well as supporting the creation of relevant national policies, strategies and institutions in third countries; · Increase policy coordination and information sharing through the international Critical Information Infrastructure Protection networks such as the Meridian network, cooperation among NIS ...

K. considérant néanmoins qu'il ne serait pas opportun d'adopter des règles de droit international privé afin de déterminer la loi applicable qui seraient biaisées d'une quelconque manière pour protéger un droit plutôt qu'un autre ou destinées à restreindre la portée de la législation d'un État membre donné, en particulier compte tenu de l'existence de la clause relative à l'ordre public figurant dans l'article 26 du règlement Rome II; considérant qu'il importe donc particulièrement de maintenir le contrôle de l'ordre public dans le règlement Bruxelles I;
K. whereas, nevertheless, it would not be appropriate to adopt rules of private international law for the determination of the applicable law which are skewed in one way or another to protect one right above another or designed to restrict the reach of the law of a particular Member State, particularly given the existence of the public policy/ordre public clause in Article 26 of the Rome II Regulation; whereas it is therefore especially important to retain the public policy control in the Brussels I Regulation;

Draws attention to problems linked to the legal uncertainty of commercial exchanges from and to non-EU countries, and to the issue of which jurisdiction is competent for the settlement of a given dispute; notes that while principles of private international law do exist, their implementation raises a number of problems primarily affecting consumers and small businesses, who often lack knowledge of their own rights; underlines, besides, the new legal challenges arising from globalisation and the development of Internet transactions; emphasises the need for a coherent approach to be adopted on an international level to avoid consumers and small businesses being punished for this situation.
