Le 20 août 2015, en application du paragraphe 11 et des alinéas b) et e) du paragraphe 12 de la résolution 2196 (2015), Soussou Habib a été inscrit sur la liste des personnes et entités «se livrant ou apportant un appui à des actes qui compromettent la paix, la stabilité ou la sécurité en RCA, y compris des actes qui mettent en péril ou violent les accords de transition, menacent ou entravent la transition politique, notamment la transition vers des élections démocratiques libres et régulières, ou alimentent les violences»; «préparant, donnant l'ordre de commettre ou commettant, en RCA, des actes contraires au droit international des droits de l'homme ou au droit international humanitaire ou constituant des atteintes aux droits de l'homme ou des violations de ces droits (violences sexuelles, attaques dirigées contre des civils, attentats à motivation ethnique ou religieuse, attentats commis contre des écoles et des hôpitaux, enlèvements, déplacements forcés)»; «faisant obstacle à l'acheminement de l'aide humanitaire destinée à la RCA, à l'accès à cette aide ou à sa distribution dans le pays».
Habib Soussou was listed on 20 August 2015 pursuant to paragraphs 11 and 12 (b) and (e) of resolution 2196 (2015) as ‘engaging in or providing support for acts that undermine the peace, stability or security of the CAR, including acts that threaten or violate transitional agreements, or that threaten or impede the political transition process, including a transition toward free and fair democratic elections, or that fuel violence; ’‘involved in planning, directing, or committing acts that violate international human rights law or international humanitarian law, as applicable, or that constitute human rights abuses or violations, in the CAR, including acts involving sexual violence, targeting of civilians, ethnic- or religious-based attacks, attacks on schools and hospitals, and abduction and forced displacement’ and; ‘obstructing the delivery of humanitarian assistance to the CAR, or access to, or distribution of, humanitarian assistance in the CAR’.

B. considérant que les massacres perpétrés par le régime Syrien à l'encontre de sa population ayant conduit le pays au bord de la guerre civile se poursuivent; que le rapport de la commission d'enquête internationale indépendante des Nations unies sur la Syrie du 15 août 2012 a conclu que les forces du gouvernement et les milices shabihas avaient commis des crimes contre l'humanité, des crimes de guerre et de graves violations du droit international en matière de droits de l'homme et du droit international humanitaire, et que ces actions étaient le fruit d'une politique d'État impliquant les plus hauts responsables des forces armées, des forces de sécurité et du gouvernement; que la commission d'enquête des Nations unies a également fait état de crimes de guerre perpétrés par les groupes armés anti-gouvernementaux, même si ceux-ci n'ont pas atteint la gravité, la fréquence et le niveau de ceux commis par les forces gouvernementales et les shabihas; que Navi Pillay, haute commissaire des Nations unies aux droits de l'homme, a invité à plusieurs reprises le Conseil de sécurité des Nations unies à saisir le Tribunal pénal international de la situation en Syrie;
B. whereas the massacre of the Syrian regime against its population, which has driven the country to the brink of civil war, continues; whereas the report of the UN Independent International Commission of Inquiry on Syria of 15 August 2012 concluded that government forces and Shabbiha fighters had committed crimes against humanity as well as war crimes and gross violations of international human rights and humanitarian law, and that these actions had followed state policy with the involvement at the highest levels of the armed and security forces and the government; whereas the UN Commission also reported that war crimes had been perpetrated by anti-government armed groups, even if these had not been of the same gravity, frequency and scale as those committed by government forces and the Shabbiha; whereas UN High Commissioner for Human Rights Navi Pillay has repeatedly called on the UN Security Council to refer the situation in Syria to the International Criminal Court;

13. invite la Russie à suivre l'exemple de la Géorgie et à donner libre accès aux médias internationaux et aux organisations de défense des droits de l'homme et des droits humanitaires dans les zones sous son contrôle et sous le contrôle de ses alliés dans le conflit; demande que soit lancée une enquête internationale indépendante pour déterminer si des crimes de guerre, des crimes contre l'humanité ou autres violations du droit international humanitaire ou des droits de l'homme ont pu être commis et par qui; demande que les personnes soupçonnées d'avoir commis de telles violations soient traduites en justice, qu'il s'agisse de poursuites intentées par les tribunaux nationaux compétents ou par la Cour pénale internationale;
13. Calls on Russia to follow Georgia's example and provide full access for the international media, human rights monitors and humanitarian law investigators to the areas under its control and under that of its cobelligerents; calls for the independent international investigation to determine whether war crimes, crimes against humanity or other violations of international humanitarian law or of international human rights law may have been committed, and by whom; calls for those suspected of having committed such violations to be brought to justice, whether through genuine prosecutions by the relevant national courts or by the International Criminal Court;

(3 quater) Les mesures prévues dans le présent règlement ne portent pas préjudice à l'adoption d'autres mesures visant à la mise en œuvre de l'accord de cessez-le-feu signé à N'Djamena le 8 avril 2004, ni à l'obligation de poursuivre et de juger, conformément aux dispositions des conventions internationales de protection des droits de l'homme, les personnes suspectées d'avoir commis de graves violations des droits de l'homme et du droit international humanitaire, ainsi qu'à la poursuite de l'enquête, par le procureur de la Cour pénale internationale, sur les crimes commis au Darfour, en se fondant sur la saisine ad hoc de la Cour par le Conseil de sécurité des Nations unies, telle qu'elle résulte de la résolution 1593(2005),
(3c) The measures provided for in this Regulation shall be without prejudice to the adoption of other measures designed to implement the ceasefire agreement signed in N’Djamena on 8 April 2004 and to the requirement to prosecute and put on trial (in accordance with international conventions on the protection of human rights) persons who are suspected of having seriously violated human rights and international humanitarian law, or to the pursuit of investigations by the Prosecutor of the International Criminal Court into the crimes committed in Darfur, on the basis of the UN Security Council's ad hoc consultation of the Court pursuant to Resolution 1593(2005).

(3 ter) Les mesures prévues dans le présent règlement ne portent pas préjudice à l'adoption d'autres mesures visant à la mise en œuvre de l'accord de cessez-le-feu signé à N'Djamena le 8 avril 2004, ni à l'obligation de poursuivre et de juger, conformément aux dispositions des conventions internationales de protection des droits de l'homme, les personnes suspectées d'avoir commis de graves violations des droits de l'homme et du droit international humanitaire, ni à la poursuite de l'enquête, par le procureur de la Cour pénale internationale, sur les crimes commis au Darfour, en se fondant sur la saisine ad hoc de la Cour par le Conseil de sécurité des Nations unies, telle qu'elle résulte de la résolution 1593(2005),
(3b) The measures provided for in this Regulation should be without prejudice to the adoption of other measures aimed at implementing the cease-fire agreement signed in N'Djamena on 8 April 2004 or to the obligation to prosecute and try, in accordance with the provisions of international human rights conventions, persons suspected of having committed serious violations of human rights and international humanitarian law, or the continuation of the investigation by the Prosecutor of the International Criminal Court into crimes committed in Darfur, on the basis of the ad hoc referral to the Court by the United Nations Security Council, as set out in resolution 1593(2005).

(3b) Measures provided for in this regulation are without prejudice to the adoption of other measures aimed at implementing the cease-fire agreement signed in N’Djamena on 8 April 2004 or to the obligation to prosecute and bring to trial, in accordance with the provisions of international human rights conventions, persons suspected of having committed serious violations of human rights and humanitarian international law, or the continuation of the investigation by the Prosecutor of the International Criminal Court into crimes committed in Darfur, on the basis of the ad hoc referral to the Court by the United Nations Security Council, as set out in resolution 1593(2005),
