De l’avis de la juridiction constitutionnelle autrichienne, la Charte est opposable dans les procédures de contrôle juridictionnel de la législation nationale dont elle est saisie; par conséquent, les justiciables peuvent se prévaloir des droits et des principes reconnus dans la Charte lorsqu’ils contestent la légalité d’une législation de droit interne. It took the view that the Charter is enforceable in the proceedings brought before it for the judicial review of national legislation, and therefore individuals can rely upon the rights and the principles recognised in the Charter when challenging the lawfulness of domestic legislation. The Austrian Constitutional Court identified strong similarities between the role played by the Charter in the EU legal system and that played by the ECHR under the Austrian Constitution, according to which the ECHR has force of constitutional law.
